Dear Sir, I had purchased a villa at Lavasa Corporation in 2007. In 2010 a major accident/land slide took place exactly below my villa. The company confirmed it and agreed to construct a retention wall for the safety of my villa and to also avoid further soil erosion. But since the work at site started after legal litigation with Government of India, the company has completely ignored the accident and is forcing me to take the possession of the property. Sir, 1. Due to continuous soil erosion the villa is not safe to stay. Major accident including family members falling in the steep slope from within the villa/plot is very highly possible. Lavasa corporation is completely ignoring all these facts in spite of many formal complaints stating the above issues with documents to substantiate it. They have now mailed me to take the possession of the property or face penalty ignoring all the above facts. Sir, I have made 80% of the payment in the first half of 2010 before the accident. In November 2013 the company said to make the balance payment as demanded and everything will be taken care of. Believing them I took loan from HDFC Bank paid, I TDS but then again I was told that nothing more with respect to land slide in my villa is required. The validity of the cheque is over but it is still with me. I am also paying EMI for the same since more then a year( similar to escrew account) Sir, help me to resolve the issue. 1.Audit report of the major land slide / accident that took place and the remidial measure taken thereafter 2.Securing the plot by lavelling the land as it is now dangerous to stay there. Sir, I have a 8 year old daughter, She can fall in the deep pit in my plot created because of the accident/land slide and continous soil errosion in last 5 years.
