Amazon Marketplace – Seller Refuses to Replace

Amazon.in vide ID NO (171-1970501-9478750) 26 Aug 2014 I purchased “Oster OT16RBS-049 40-Watt Remote Control Tower Fan” for Rs 2930/-.Since the product was not meeting my expectations, as per amazon policy I initiated return process.The seller M/s Kunal Electronics 101 Apna Bazzar, Gurgaon, refused to take return which is against the policy.I contacted amazon.in through chat and they contacted seller.Seller then promised me to reverse pick up the item through courier but till 26/09/2014 he made no attempt to pick up despite several assurance through mail.Again I contacted amazon.in and their account department asked me to ship the item to the seller otherwise they will close the refund request within three days.Then I reverse shipped the item with expenses from my side to the seller and he received the item.The same was confirmed by the seller by mail on 29.09.2014 with assurance to refund the money back soon.Since then I trying to get the amount refunded.Now it is several weeks have passed neither amazon.in nor the seller is responding to my repeated reminders.

I claim my refund Rs 2930/-Plus reverse sending courier charge RS 270/-with penal interest of 15% for the delayed period. Also I demand consequential damages Rs 3000/- from amazon.in/seller for the trouble, mental agony and hard ships caused by their culpable act of negligence.
