Arawali Heights – Delay in possession and lack of Amenties

I booked a flat in Arawali Heights, Dhaurehra, and Haryana in Aug 2006 under construction linked plan. Bhoomi Pujan of these flat was done in March 2007 and thereafter demand for each slab was raised every 3 months. Demand was raised for completion of some of the slab for which construction was not even started at that time, hence payment was not made till the time construction for those slab not completed. Builder took 95% of the demand till March 2010, including EDC, IDC, and Club and parking charges. There after plastering and finishing work took 3 years and possession was offered in Mar 2013 on basis of conditional OC. When possession was offered Status as on date Lift was not operational Operational in Dec 13 Underground / ground parking was not complete 2 blocks are still under construction Work on park and other internal amentias was not even started Since parking of 2 blocks is under construction hence park of these 2 location not yet completed No jogging track, no sports facility, yoga center and other recreational activities not yet started which was promised in offer document Fire safety equipments were not installed. Few are installed and few yet to be installed since equipment was installed basement STP WIP Work completed but not yet operational Club House was not existent Club house was made on Ist floor on 2000 Sq ft including swimming pool of 500 Sq ft. Shops were constructed in GF which was not in original plan. Surprised how this club house is sufficient for 1500 families. Water Line from HUDA not connected Supplies from water tanker Electricity connection – 33 KVA No space and intention to install. Presently supplied from Genset. No family was shifted till Dec 13 100 families shifted and living with compromise. 400 flat owners took the possession. Builder is so far providing electricity at 75% Huda and 25% Genset rate As per agreement building was supposed to be handover in 36 months from the date of start of construction. At the time of possession builder is charging interest @ 36% beyond 90 days delays and 18% till 90 days whether the demand was genuine or not. We, some 80 flat owners form 6-7 group and filled cases against builder in different consumer court. Some are at National commission, some are at state commission and some are at district forum. Since last 18 months builder is able to get the dates from court by giving some reason or other. Some time court ask to arrive on out of court settlement and some time on technical ground date was extended. In our last hearing all the 3 courts extended further date of 6 months (Surprising all 3 courts). Since builder got time to complete the project (As mentioned in above status report), our faith to get justice also fading. We are now planning to file writ in Chandigarh High Court. We filled various RTI’s but response of each of the RTI is incomplete or gets not related answers. Our basic demand is • Completion of all amenities as mentioned in
