With due respect I beg to submit that I had signed an Agreement with PROJECT HEAD ARUN MISHRA (AFO14/01)/RADHIKA GUPTA (AFO14/08) of ARYAN FOUNDATION, an NGO, 16-B Bhagwati Garden Extention , Dwarka More, New Delhi, (Certificate No.IN-DL11117566208381M, Account Reference : IMPACC (IV)/dl736703/DELHI/DLDLH,Unique Doc.Reference : SUBIN-DLDL73670319363493200651M on 19/09/2014 for allotment of an Agency-Agency Address-266E/50, Ward No.2 Mehrauli, New Delhi11030 (Agency Code MRY/DL-16) EMAIL ID (aryanngomry16@gmail.com).for distribution of food items for public on cheap market rates in our locality on certain covenant’s as laid down in the Agreement (copy enclosed for kind perusal).I deposited a sum of Rs. 1,00,000/-(rupees one lac only) as a security amount vide cheque dated 19/09/2014 which I had borrowed on loan basis from my father in-law and Rs.50,000/-(rupees fifty thousand only)out of which Rs.23,500/- (rupees twenty three thousand and five hundred only )for purchase of food items from Aryan Foundation and Rs.26,500/-(rupees twenty six thousand and five hundreds only) for Cards Fee in cash on 24/09/2014 (copy of receipt enclosed)swith Aryan Foundation for allotment of the said Agency: 266E/50, Ward No.2, Mehrauli, New Delhi-110030.But due to unavoidable family circumstances I could not run the Agency and requested the Project Head ( Shri Arun Mishra) of Aryan Agency, NGO on 30/03/2015 to cancel the Agency allotted to me. Subsequently I requested the Aryan Agency by Mails on 08/04/15 and 15/04/2015 to refund the security amount or Rs.1,00,000/-(rupees one lac oly) as well as Cards Fee of Rs.26,500/-(rupees twenty six though and five after deducting Rs.38,612/-(rupees thirty eight thousand, six hundred and twelve only) due to me from Rs.1,50,000s/-. Now, Aryan Foundation is required to refnd my due of Rs. to me .In the second week of April, 2015 I contacted Shri Arun Mishra on his mobile No. 9650xxxx for refund of my due of Rs.87,888/- (rupees eighty seven thousand, eight hundred and eighty eight only). He assured me that he would put up my case in the meeting of Aryan Foundation on 02/05/2015 and get the security amount and cards fee amount refunded to me at the earliest. I again tried to contact Shri Arun Mishra on 07.05.2015. But I could not contact him as his mobile was switched off. I contacted Aryan Foundation Office on Mobile No.965019xxx and I was told that Shri Arun Mishra has been absconding from Aryan Foundation Office for the last few days.

Now, I humbly appeal the Hon’ble Consumer Court to kindly give necessary directions/orders to Aryan Foundation, an NGO to refund me my due of Rs. 87,888/-(rupees eighty seven thousand, eight hundred and eighty eight only) at the earliest.
