I, Vipin, booked a flat Unit no A-1007, at Discovery Park, Sector-80, Faridabad, Haryana. on 05-12-2012 by depositing cheque No. 009714 dated 05-12-2012 for Rs.3,46,500.00 along with application form dated 06-12-2012 under construction link plan. Through the company’s authorized estate agent Mr. Malhotra Director of M/s Rama Krishna Prop Shoppe Pvt. Ltd, Head Office :A98, First Floor, Inder Puri, New Delhi-110012. Mr. Malhotra explained to me that it is a very good project and I am working for the company for last more than 10 years all licenses and necessary permissions of the project have been duly got approved by BPTP so it is a safe.As it is a and good project you can invest your hard earned money. I accepted this flat at a higher rate of Rs. 4000/- per Sq ft from the company where as the same was available at a cheaper rate in the market because of its premium location. On 20.12.2012 the company issued me allotment letter mentioning my customer code: BE67/144206 and confirming me that the Flat no A-1007, at Discovery Park, has been allotted to you. I signed the Builder Buyer Agreement with M/s BPTP LTD, M-11, Middle Circle, Connaught Circus, New Delhi-110001 on 26/03/2013. The Builder Buyer Agreement clause 2.1 clearly mentioned that Flat bearing No A-*1007, floor 10th, Tower A, in Discovery Park, Park land, situated in Sector -80, Faridabad. is booked for me. On 10.01.2013 I paid Rs. 8,07,312.00 to the company vide their receipt no 2012/1600033343 On 10.01.2013 I paid Rs. 4,68,857.00 to the company vide their receipt no 2012/1400040669 There was no communication from the company about the development of the projected I visited the site many times but there was no sign of any development. Then some one told me that BPTP is not going to built’ A’ tower in which you have booked your flat and you have been cheated by the company. I visited the company in September 2013 and enquired about the status of my flat, and then the customer care representative confirmed me that the company is not constructing ‘A’ tower and we will allot you some alternative flat in some other tower. It was a shock to me and I feel cheated by the company and it tentamounts to fruad against me by raising money for the flat / Tower which they are not going to construction at all. I told them very categorically that if you are not going to provide me the flat booked by me, I am not going to accept any alternative flat and you should refund my money that I have deposited with you alongwith the penalty / interest mentioned in the Agreement vide clause ——————- It seems the modus operandy of the company to book more number of flats at higher / premium price by showing attractive location of the flat
