Case of fraud and harassment by landlord in delhi

Dear Sir,

My name is Charanjeet Singh resident of New Delhi.

On 13th February 2018, on the auspicious occasion of Shivratri I had shortlisted an office in Nirman Vihar, New Delhi -110092, with the help of a freelance broker Mr. Sonu.

Office address: Office no: 410, ABC Complex , Veer Sawarkar block, Nirman Vihar, New Delhi -110092.

Landlord Name : Mr. Sumit Wadhwa

On my first visit on 13th February 2018.

1. Office needed renovation like white wash etc. On white wash Landlord Mr. Sumit Wadhwa argued with me, saying that I can sell this office without whitewash itself. Still I will do favor for you.

2. All the chairs were messy in the office, I told them to get it repair. After my numerous visits via metro from my home to their office to start my work at the earliest. My home is 25 km away from this office, which consumes around 2 hours for up and down per visit. Mr. Sumit repaired the old chairs instead of giving us new chairs what we asked for.

3. There was termite in boss cabin cupboard, took 14 days to repair the simple plywood. It’s me who told them to change the backside of plywood so that someone can sit here.

4. Lizards were roaming inside the room, since office was shut down since months.

5. At the reception area inside the office itself, there was small power box that needed a minor repair, it took them some 15 days after I told them to tight one screw from the electrician. Earlier they were sayings it’s impossible to repair.

6. There were some other repairs that are pending as on date and are not completed by the landlord as per his promise. There are three ways to go up to the top floor (Lift, stairs and towing stairs / sliding stairs).

7. No light in the washroom and they said that we are getting some arrangement done for our tenants, it was a false promise.

8. While I was there for less than a month, they stops the water in the evening time since day one and many times in day time as well. Just imagine if someone is sitting on the pot and he want to flush, what he or she will do in that critical situation? Landlord also cheated us in this, that he will get the water supply done in a week time.

9. 4th floor and ground floor is full of dust and urine smell (Especially in the towing stairs, towing stairs is exactly opposite to the age old lift in that building ABC Complex).

10. It was my first attempt to start a new company which I planned to start. I was taking interviews to find out the better employee to start a new company based on expert candidate. While interviewing, my candidates told me that there is lot of smell and dust inside your building, and towing stairs is stinking like anything due to urine smell and garbage kept there in huge amount.

11. There was no fan in boss cabin. Landlord was not at all aware about it. It’s me who told him to install one. After installing fan, few days back they told me that I have spent money on fan for your office. I told Mr. Sumit, that it is your premises if you spent, it’s your fan and it’s your office.

12. Handle of outside Cupboard was broken that I repaired it with screw driver.

13. Air-conditioner needed cleaning. Which Mr. Sumit has not done till date. Reason being, they said very soon we are going to get boring done in our building. When water will come, we will clean your air conditioner.

14. There was no key of any cupboard given to me. I tried spending money to get the duplicate key for those locks. Lock repair person said, these locks cannot be repaired. Mr. Sumit was silent on this.

15. Half of the ceiling lights were not working. After I argue with them on this, they agreed to get it done. But even in that, they repaired few lights only.

Perhaps after my complaint they may clean it for a month or two to fool you and other tenants. Earlier I was thinking to stay silent or raise my voice against it.

Candidates I shortlisted, they were not ready to join since they were not satisfied with office premises facility such as water availability in the toilet and garbage inside the building. One of the lady candidate, called me up asking Sir, is there no light in washroom? What should I say her on this? That it was my biggest mistake to enter this building where tenants are mute.

16. Due to these reasons I had to vacate this dirty place at the soonest I could. I took all of my valuable belongings on 9th April 2018 evening time before they get stolen. I found no other way to mediate. Mr. Sumit never listen to anyone. What he speaks is like a stone line. No tenant dare to argue with him.

I request you to kindly get my refund done for the 2 month rental which I paid that is rupees 30000/- . AND take strict action to Seal or Clean this builidng .

Break up is below:-

Broker payment: Rupees 5,000/- Excluding the above 30,000/-

Cash payment to landlord as token money: Rupees10, 000/-

Rest 20,000/- was pending.

(200 for electricity repair work done by me for the landlord + BSES bill of 480/- paid by me on 12th March 2018 ) minus 20,000= 19,320 rupees)

Rupees 19,320/- was deposited via online transfer to Mr. Sumit’s bank account on 12th March 2018 evening to start my rent from 13th march 2018. On the same day Mr. Sumit told me to take your agreement tomorrow on 13th March 2018, as I had already given my adhar card copy to the broker Mr. Sonu. He told me on the phone that I have told Mr. Sumit many times to send me the details for agreement preparation. Mr. Sumit is not sending.

Agreement was not given to me till date, even after paying the complete amount and helping him in repairing his office.

17. On 14th March 2018, I bought an HP Desktop since I had already planned that when I will start sitting in that office, on the next day itself I will buy computer to start taking interviews. I have the bill of that computer as well.

18. On 16th March 2018, I called up for WI- FI connection. Without internet, office work is not possible. I have receipt of internet connection for 16th March 2018 as well.

19. Numerous time I told Mr. Sumit to repair the furniture. They keep on delaying to save more and more money.

Mr. Sumit wasted my time since 13th February 2018 to 13th March 2018 to make it ready.

20. I was coming from my home every alternate day to check whether they completed office no. 410 or not. Spending 70 rupees on each travel via metro train to check the repair work. Getting the work done was their task. Still I was wasting my time and money to travel from Vishnu garden to Nirman Vihar since 13 February to 13 March, until it’s completed.

21. Gents can manage unhygienic place up to some extent. There are ladies working on that floor, they should feel ashamed on this, how they will be managing their washrooms where water supply stops any time and how they walk through the dark and smelly towing / declining stairs while leaving office if the lift do not work.

Twice I informed few ladies while they were visiting common toilet, that water is not coming. And she was informing her boss that Sir, again water is stopped. Felt mercy but I was helpless.

On 8th April 2018, I phoned Mr. Sumit , informing them that again pending BSES bill has come which you had not cleared. While discussing the same, they told me that your rent is due, I told them I joined on 13th March.

22. They threatened me on the phone that you did not join from 13th March, you joined on 5th of March 2018. Their security guard Mr. Raju is also lying as he is working under Mr. Sumit. Mr. Raju lives on the roof top in a shed given by Mr. Sumit. Mr. Raju has started saying that I joined from 5th March as you were taking the keys from the roof. I was informed by broker to take the keys from Mr. Raju on top floor to see if the work is done or not. As already informed, I was taking keys just to see whether they have completed my office or not. Since day one they were playing. They do not want to spend money on their repairs.

Being the mentality of landlords we can understand. They expected me to repair their office at my cost. They felt bad when they invested money in their office. They have harassed me a lot to the limit they could.

23. I lost deserving candidates for my office work due the dust, garbage and urine smell inside the building. Assuming they will get it done in a week or 10 days. Later I came to know from other tenants on 4th floor, they tried a lot to convince Mr. Sumit to manage flush water and sanitation for us. But he is least bothered about it. Mr. Sumit ignored each time. He has no worry on the matters I discussed. He just want rent money and enjoy.

I have heard, Mr. Sumit is the owner of the flats on 4th floor. It should be his responsibility to clean the floor and building, in touch with other landlords.

I ask Mr. Sumit that is this what is called Swachta Bharat Abhiyaan???

I have paid Mr. Sumit 2 month advance rent. Now, I want it back to my bank account.

Plus money I spent on metro since 13 February 2018 to 13 march 2018 while coming to their office to check and repair their office. It was a double task for me as if I am their servant to repair their office wasting my time and money.

They are ready to accept rent form the tenants but not ready to get the sanitation work done for them. I have listen the plight of tenants. They scare to complain, if they complaint they will be thrown out of the building since they are living there since long time. May be they got the office at cheap rate long time back and they do not want to complaint.

Still I expect even if the rent is less, no one should urinate in social place where people move around. If it’s done, that person should be stop him from doing so. But how they will stop? There is no light in towing stairs as well. Anyone can do what they want in that darkness. There should be someone to clean it on daily basis once or twice a day.

On 8th April 2018, Mr. Sumit called me and threatened me that if you pay rent from 13th April, I can lock the premises, then what you will do? They had the power to steal my office items anytime as I was given 1-1 keys for 2 doors of my office. And I believe they would have duplicate keys of this office for emergency. Do you think an office at stinky place can cost even 15000/- for which we agreed on day one? Payment was done on his agreement. Threating call voice record I have for this. Mr. Sumit also boasted that I can rent this office for rupees 19,000. Now you can imagine their nature and way to talk. Perhaps he may be very polite with you.

24. I was quite disturbed because of their attitude since day one and the office where I got trapped due to their fake promises. Due to which I was unable to run my work. Even after knowing that my rent starts from 13th March, Just due to their threatening call on 8th April, I could not sleep whole night and decided to take off all my office items, such as computer etc. from Mr. Sumit premises to avoid any theft of my items in near future.

I have the voice record of Mr. Sumit’s threatening call as well a proof that I can share if required.

25. Today, on 11th April 2018, I specially visited security guard office at ABC complex on the roof top and handed over the keys to Mr. Raju in a formal manner.

On reaching home, i called up Mr. Sumit wadhwa, he is not ready to pay me my money i paid him in advance for the dirty property. He also threatened me on next call, do not dare to call me again. Just imagine its me who is complaining think about those poor and innocents who do not even complain.

Since I am a vigilant citizen of India, I find it’s my duty to inform if something is going wrong nearby. Why should I mute myself if the landlord is getting dictator on all the tenants?

After my complaint, if Mr. Sumit tries to threaten me or do any unlawful act against me. Mr. Sumit Wadhwa and Delhi police will be held responsible for it. They have harassed me a lot since day one.

If no action is taken over my complaint, then I will have to take escort of print and online media to cover this breaking news.
