Deviation to Agreement

I had taken a home loan from ICICI Bank (Home Loan A/c no. LBMUM00001242861). The Loan agreement was signed on 10th February 2006 with a discount margin of -1.5% on FRR and the loan amount was disbursed on 14/15.02.2006. Subsequently an amendment (copy attached) dated 21.02.2006 (referring to the terms & conditions of the agreement dated 10/02/2006) was issued revising the discount margin to (-) 2% on FRR, since the disbursement availed on or after 13/02/2006. Accordingly, the Bank recovered the first two installments (EMIs) with an interest rate applying a discount margin of (-) 2% on FRR as per the amendment letter dated 21.02.2006 but subsequently switched over to a discount margin of (-) 1.5% on FRR unilaterally and continued till the last EMI paid. I noticed this deviation by ICICI Bank lately during March 2009 and complained to ICICI Bank customer care desk at their Race Course, Andheri (East) & Thane offices, and requested ICICI Bank to honour the stipulations in the amendment issued by them and refund/readjust the excess amount of interest recovered from me. The Bank did not consider my request & informed that the Amendatory Agreement dated 21.02.2006, which was received with a discount margin of (-) 2% was handwriting error (Email dated 24th April 2009 enclosed). Finally, the bank have said that the letter dated 21.02.2006 received by me has not been issued from their end (letter dated 11th November 2009 enclosed) – this is unfair on the part of ICICI Bank and hence not acceptable to me.

I request your honour for due consideration & direct ICICI Bank to refund the excess amount of interest recovered (Rs. 87,488/-) from me along with (a) interest @ 10% (Rs. 8750/-)& (b) reasonable amount of compensation (Rs. 50,000/-) towards harassment. I am under tremendous mental pressure due to the unexpected behaviour of ICICI Bank. .
