Fraudulent / Cheating / Misguiding by RealEstate Marketing Agent

Respected Sir,
This is to state that, six month back (February -09) I have booked a flat in multi-storey building (G-7) which is presently under construction in Ultadanga, Kolkata with the help of Mr. Tapen Saha (9830882753) a marketing agent of M/s Sanjjogproperties Pvt. Ltd at Ballygunge, Kolkata.13,D Deodar Street, First floor, Kol-700019 Ph. +91 33 2474 1545 / 44 / 43

At the time of this flat booking “I told to Tapen Saha a marketing agent of Sanjjogproperties Pvt. Ltd that,
It would be my investment purpose to a flat not to staying or residential purpose for me”
So, I need to RE-Sale this flat within 6 month period from the time of booking this flat

The flat booking agent “Mr. Tapen Saha was assured me that, this booking flat would be certainly (100%) sold out within 6 month time. You have to just invest now Rs. 1 lakh for the token/ booking money for that particular flat”

So, as per his suggestion and relying on him I gone ahead and I booked this flat with Rs. one lakh as token/booking money and got the money receipt from Sanjjog Property Pvt.Ltd and afterward I returned to my working place on aboard in February -09

After 2 month (15th May-09) I returned back to India and the agent (Tapen Saha) again asked me to submit another rest of the amount as per 10% of property value and do the agreement with the property developer

In this regard I reminded him & told him that “I have booked this flat for Re-Selling purpose not to keep with me and keep paying continue as they required and also I am not interested to pay even I am unable to pay a single rupee in thereafter, I just want to re-sale this property ASAP as I told you earlier “

Mr. Tapen Saha the booking agent was given again assurance to me that “he is trying to Re-Sale this property and expecting it would be sold out very soon and that is 100% guarantee”

In the procession I had to give them another Rs. 3, 37220/ to the developer for 10% of the total flat value
that means my investment is total Rs.4,37220/ to this flat

As soon as the agreement has been taken place he & his fellow members “Tapen Saha & group of Sanjjog Property Pvt. Ltd are keep asking to deposit more money as soon as possible as per the payment schedule of the under construction building to the developer instead of selling this flat to the 3rd party”

In the mean time I found a flat purchaser & tried to resell that flat to him but the marketing agent still saying that, “I can not re-sale this property or flat without making the payment to the developer “which is totally bullshit because there is no such a norms in the purchasing agreement between property purchaser & seller

Consecutively “we are also keep telling to agent of Sanjjogproperties that it is totally impossible for us to give you a single money to the developer due to our domestic financial problem and you kindly re-sale the flat without any delay an get back my invested money as soon as possible as its desperately required for us”.

Therefore, I am feeling totally fruitless in this regard and I am thinking that I am being cheated or misguided by this Tapen Saha a marketing agent of Sanjjogproperties Pvt. Ltd as well as its Organisation

So, kindly advice me what is the solution and let me know how to relieve and retrieve my invested money from this fraudulent trap or money making racket and what kind of legal aids can I have to go ahead against these fraudulent and dissolve this matter please……
