Goodwill Carz Dealer Not paid full amount in resale

A used Hyundai Santro car (hereafter car) bearing registration number KA 03 MA 7511 was purchased on 30th June 2014 with an amount of Rs. 1,22,000 (Rs. One lakh twentytwo thousand only) from the used car dealer (hereafter dealer) Goodwill Carz, located at No. 46 Annipura Main Road, Off Double Road, Sudam Nagar, Bangalore – 560 027, in the name of my wife Mrs. Gayatri Laipubam, then residing at No 32, Konena Agrahara, HAL Post, Near Rajeshwari theatre, Bangalore – 560 017. (Sales Agreement is enclosed) As my wife had to leave Bangalore due to pregnancy, we decided to sell the car. Initially, the resale value for the car was proposed at Rs. 1,20,000 by us with the dealer (the same dealer from whom the purchase was made), on which the dealer asked us to keep the car at his shop/showroom if we wanted to sell the car at a high price (Rs. 1,20,000). Hence, the car was handed over to the dealer on 8th October 2014. After a couple of days, the dealer suggested us to sell the car at a lower price to finish the deal soon, on which we agreed to sell the car at Rs. 95,000 (Rs. Ninety five thousand only) which includes a commission of Rs. 5,000 for the dealer. After the information of the sale, we requested the dealer to pay us the full amount of Rs. 90,000 on 23rd Oct 2014. However, on 23rd Oct 2014, only an amount of Rs. 50,000 was paid to us. Whenever, the dealer was asked, as to, when would he pay the remaining amount, he kept saying, within 3-4 days. Finally, the remaining amount of Rs. 40,000 was agreed to be paid on or before 2nd Nov 2014. However, the dealer has not paid us the remaining money so far. Your kind attention is sought in this regard to help us settle this issue as soon as possible.

As it has been about one and a half month since we handed over the car, we would like to settle the deal with the initial amount of Rs. 1,20,000 that we proposed. We agreed to sell the car at a lower price of Rs.95,000 as the dealer suggested to finish the sale deal soon. Further, any charges to be borne by you and Rs.50,000 as a penalty/compensation is sought for the inconvenience that the dealer has caused us.
