IFCI Infrastructure – delay in delivery of flat

FCI Infrastructure Development Limited, builder Sub: Complaint against the Unfair Trade Practices adopted by IFCI Infrastructure Development Limited (IIDL) subsidiary of IFCI Limited [Public Sector Uundertaking] in selling and allotment of Flats in 21st Milestone Residency, Meerut Road, Ghaziabad. We are the bonafide buyers of a flat in the Project “21st Milestone Residency” promoted, constructed and developed by IFCI Infrastructure Development Limited [IIDL], a subsidiary Company of IFCI Limited [Public Sector Undertaking], and are seriously suffering in the hands of the said company despite having paid the application amount and further ready and willing to pay the Balance amount, however, due to certain discrepancies pointed out by us in allotment agreement, IIDL despite the repeated requests, reminders and meetings by us is not issuing the allotment letter. The background is as under: 1. IIDL is a subsidiary of IFCI Ltd., a Government of India undertaking and is engaged in construction and development of various residential and commercial buildings, and in pursuit of the said objects is also developing and constructing a multi-storied flats/apartments complex named as “21st Milestone Residency” at Meerut Road, near DPS School, Ghaziabad consisting of various residential flats located in different towers in the said residential complex. The Chairman of IFCI Limited is also the Chairman & Managing Director (CMD) of IFCI Infrastructure Development Limited [IIDL]. 2. IIDL Company with a view to sell the said residential project have issued advertisements to general public by various modes including placing hoardings at various intersections in the city and by which has been offering the residential flats/ apartments in the aforementioned project. 3. I booked one flat in IIDL 21 mile stone residency around more than 3 year back, 4 more flats were also booked by my relatives and friends in same project, and we opted Down payment option. (90 % payment is already done by all 5). We have not got possession till date. I called to executive ( Mr Ganesia) of the company over phone around 4 month back, I was assured I will get possession in the month of June 2014. I am not finding any progress in that project. There are fair chances that I am not able to get possession till nov-dec 2014 as project is stand still. I am loaded with 2 burden one is rent another is EMI. Company is not full filing their commitment ( march 2012 delivery date). Being a company with majority share holding by Govt of India I trusted on the project which is failing. What should I do ?
