IRCTC – Non Refund of Lower Berth Ticket Fares

I booked two LB tickets through IRCTC portal after selecting the option Book only if 2 lower berths are allotted. However, despite my option, and to my utter dismay, the journey ticket was issued allotting one middle berth and one upper berth, vide PNR No. 4529241233. I am a ripe old man of 84 years and my wife is 74, both with age-related ailments. In the circumstances, I made it clear in my mail dated 14-02-16 to IRCTC that I did not intend travelling on 02-03-2016 by the train No. 22640 using the allotted berths. Since the ticket was issued contrary to my instructions, the question of my cancelling the ticket did not arise. It wasfor the railways (IRCTC) to make amends by doing either of the two things: cancel the ticket and refund the full fare paid by me or, alternatively, allot two lower berths in the same coach as opted by me in the same train. I sought to know what IRCTC intended doing enabling me to make my travel plans accordingly. I also made it clear that any delay in deciding the matter would inevitably cause me inconvenience and hardship. In its e-mail dated 20-02-16 IRCTC confirmed: “The amount is (sic) debited towards IRCTC for TXN will be credited in your account as soon as possible.” However, the amount has not yet been credited to my account despite many reminders. In fact, IRCTC has now reneged on its commitment to credit the amount back to my bank account. By making this commitment, IRCTC admitted that there was default, negligence and deficiency in issuing the ticket in question.
