Kaunsa.com – Refunding Money

Before the Hon’ble District Consumer Redressal Forum, Navi Mumbai 1.) I Mr.G.Jithendra Reddy as a complainant Vs. Kaunsa.com as an Opposite party 2.) Complaint under Section 12(a) of the Consumer Protection Act. 3.) I G.Jithendra Reddy working as a Senior Software Engineer in iGATE Global SOLUTIONS,AIROLI,NAVI MUMBAI residing at Neelkamal CHS,Ltd,Plot-17,Flat-204A,Sector- 5,Ghansoli,Navi Mumbai, Maharashtra – 400701. 4.) Kaunsa.com a Online Shopping portal addressed as Mify Solutions Pvt.Ltd,SF 204,Singhal Tower,Sec-58,Noida,Uttar Pradesh, India. 5.) I hereby inform you that I have paid Rs.19,365/-(Nineteen thousand three hundred sixty five) towards Kaunsa.com(Opposite Party) on purchase of Toshiba LED TV on 12-09-2013 (September 12th of this year) through the my AXIS Bank Credit Card. 6.) While booking the order as per kaunsa the delivery of the product would be in 7-10 days, After payment has done kaunsa team replied me saying that the delivery will be done in 15 days i.e. 27-09-2013 (27th September of this year). 7.) Kaunsa keep on postponing the date of delivery after 27th September,2013. 8.) Finally I (G.Jithendra Reddy) as a customer requested kaunsa to cancel my order and refund the amount (19,365/-) which has been paid towards the purchase of the product as it is not getting delivered by kaunsa. 9.) After hundreds of phone calls kaunsa finally accepted to refund the amount(19,365/-) which has been paid towards the purchase of its product in 15 working days stating the refund process will be starting on October 3rd of 2013 and the amount will be paid to me by 18th October,2013. 10.)But till today 24th October of 2013,Kaunsa has not refunded back the amount(19,365/-) which I have paid towards its product purchase,Inspite kaunsa team used to be very rude in answering whenever I ask them to refund my money. 11.) As the payment has made through my Axis Credit Card, I have to repay to bank on due date 30-10-2013(which is specified by the bank), if not I have to pay the entire amount with interest which is specified as per the Banking Credit Card Policy. 12.)As I didn’t get the ordered product from kaunsa nor the money which I have paid towards the purchase to kaunsa, it is difficult for me to repay the same amount to Axis Bank. 13.)So as per Section 12(a) Consumer Protection Act, As a Customer of kaunsa I have a right to demand the product for which I have paid and also have a right to demand for refund if am not getting the product, But am getting abused by kaunsa for asking the same. 14.)As per the recent discussion with kaunsa, it is supposed to refund the amount by 25-10- 2013,But I have no trust in their commitment as they keep on changing the dates. 15.)Phone number 0120-4835000 which kaunsa has specified in its web portal is very difficult for customers to connect in order enquire about status of his purchase
