Managing Director, Mohan Palms, Badlapur Dear Sir, Subject: Booking of 1 BHK Flat No: A/403, VIVA MOHAN PALMS,BADLAPUR*** I had applied for a 1 BHK Apartment in your upcoming mega project at Badlapur on Sept 2010 along with a payment of Rs.352716/= paid vide cheque of Canara & HDFC Bank subsequently I was issued a letter no. & date nil of your provisional Allotment. Accordingly as per your construction linked payment till 31st June 2012 we paid a sum of Rs.1410865/= which is 100% of value of Flat as per your demand. At the time of booking we were told that the foresaid maintainence will be charged at Rs1/-per sq.ft & the Corpus fund will be at the rate of Rs 40-50 per sq.ft.which was later revised to Rs 2.50 per sq.ft & Corpus Fund to Rs 100 per sq.ft.As per the rules you are allowed to collect 12 Months maintainence as advance & not 18 months.All your amenties are still not in place & will take more than 18 month for complete makeover.Morever I have to bera losses due to non delivery and non performance of explicit contractual obligation of a non delivery of the aforesaid of flat in 24 months on schedule time otherwise I shall have no option other than to seek appropriate remedy under the law for the protection of my rights and you shall be liable for all the risks, consequences and costs thereof.
