M/s Pandit Automobiles Pvt. Ltd …Respondent 01 M/s Maruti Suzuki India Limited …Respondent 02 That the Claimant had purchased new Maruti Swift Desire VDI from Respondent 01 on 14.02.2014.The Claimant had processed the loan from Punjab & Sind Bank, Jalandhar.During purchasing of Vehicle Respondent 01 told us that “we will provide the vehicle but Registration of Vehicle will be done at your end”.To my surprise, on the delivery of vehicle showroom issues Form 21 in the name of Regional Transport Office Jalandhar.On enquiring about non-issue of Form 21 in the name of Regional Transport Office Yamunanagar, Respondent 01 told that your loan is from Jalandhar, so Form 21 is in the name of RTO, Jalandhar.The information provided by Respondent 01, at point no 5, was not been provided to Claimant during the enquiry of Purchase of Vehicle.Claimant’s brother wrote an e-mail, on 03.03.2014, in the aforesaid subject to reissue the Form 21 in the name of RTO Yamunanagar to Respondent 02.After this e-mail Respondent 01 telephonically (Mobile: 9812455xxx) communicated that they are unable to issue Form 21 in the name of RTO Yamunanagar stating “it is obvious that the registration of vehicle is in the same state as that of billing address”; but it is not obvious to the laymen who is not dealing with the cars daily.Claimant’s brother again wrote an e-mail, on 07.03.2014 to Respondent 02 for redress of after sales grievance.As one month of Temporary registration is expiring on 13.03.2014; So, Claimant do the necessary documentation for registration of vehicle at RTO Jalandhar.After the registration formalities are over, Claimant’s brother got an SMS (Mobile: 9569118xxx) from Respondent 01 stating “your finance has been done from Jalandhar and according to finance policy your bill will have to be on the address provided to the financing bank.” Claimant’s brother called on above number on 25.03.2014, they told all the fault lies with the Claimant, as we have not asked Respondent 01 about this information and told to give Respondent 01, NOC from bank stating they will not have any objection for issue of Form 21 in name of RTO Yamunanagar; Which previously completely refusing any such modification in reissue of Form 21.Respondent 01 statement as above, clearly signifies that the responsibility of seeking information lies with the customer and dealers may hide or mould or suppress any information according to them.Moreover, Claimant had done all the formalities of registration of vehicle in Punjab before 18.03.2014, so this option becomes null and void. If the information regarding merits & demerits of providing the address at the time of booking is provided to claimant during before sale enquiry, then Claimant may provide the address of Yamunanagar & process the loan from Yamunanagar itself. Moreover, in the invoice of Vehicle Respondent 01 had charged an amount of Rs. 4,500/- towards Handling Charges which are also unlawful and is not in compliance of Motor Vehicle

Extra charged Handling Charges 4,500.00 10.Interest on extra charges @2% pm upto 31.03.2014 135.00 Total 94,503.06 Extra financial implementation on Claimant is as per S.No’s. 2, 3, 4, 5, 9 & 10 which sum out to be Rs. 56,802/-.
