Paradise City, Palghar – Taking Excess Payments

I have booked a flat from the above builder in Paradise City in Sector1 Bldg. No. 3, Flat NO. 105 and the builder has registered the flat in the june, 2012. Earlier the builder has asked to register the flat in the month of Feb, 2012 and collected the necessary regd. and stamp duty draft. but after keeping the draft for two months the same has been returned and they have asked us to deposit the new draft as the charged for registrtion has been raised. By this way we have lost Rs. 42 thousand due to negligence of the builder. After Registree of the flat the company has provided the NOC for housing loan which is not in the format provided by State bank of India. For the last six months I am mailing/personally visited the premises but no NOC has been provided. Meanwhile the company has completely stopped the work of construction at the workspot and no activity is presently going on. The builders office regularly harassing me by not providing the loan documents in the proforma provided by State Bank of India on the ground that this sector is under some legal problem with Allhabad Bank.

My excess payment of Rs. 42000/- plus Processing fee for Pre Approving letter from SBI should be immediately returned from the builder. Builder should be asked to inform the exact legal position on the Sector 1 as they are not providing the NOC in SBI prescribed format. I am very much clear that mental and physical harasment can not be retrieved but all the financial loss due to falsehood/delay tactis of the company should be beared by the company. There is lot of my friends who have purchased the flat from the builder are in the same agony. please take the matter with the builder as we are very much frustrated.
