I have purchased Flat No. G-01/J at Nikki Nagar Adharwadi, Kalyan (W) from Mr. Ramesh Kumar B. Nahar 22 years back but the said builder did not give Completion Certificate and Occupation Certificate from KMC/KDMC, did not give NOC from MSEB and even did not give possession of the flat. He has cheated me by installing 440 V 6-Way Feeder Pillar near by my flat which caused damage of the flat. There is always a fear of accident there, there is always fear of insects living in pits/holes there, in rainy season it is full of water seeping to the wall due to capillary action, the builder has formed society and all are harassing me combining together, condition of the flat has become pitiable. Mr. Ramesh Kumar B. Nahar, the proprietor of M/S Sailesh Developers (now Builders) is challenging me to do any thing, he can not give possession of the flat. [133490]

I have suffered Physical Damage: Rs.5 Lacs as all walls, doors, windows, etc have been broken. Average Rs.5000/- per month for 22 years loss as rent. Taxes/rent to KMC/KDMC and MSEB Society Charges if considered.

I Wanted at least Possession of the flat along with all documents mentioned above after making the flat in condition. Will be more happy if the Pillar is shifted in the garden nearby as the authorities of MSEB had prepared estimate for Rs.22,400/- 22 years back but the builder refused to give money. Since the flat is in use of the Society, a rent of Rs.5,000/-per month is receivable. If keeping the pillar in the same condition, Rs.5,000/- pm is again receivable as rent of the pillar being maintenance charge of my flat due to this and Rs.5,000/- pm towards accident liquidity damage. Rs.15,000/- per year towards a torture due to such ignorance and negligence. All other expenses due to such complaint and play.
