It is the case of adopting unfair trade practice and misleading facts to promote sale, by the style spa showroom at Faridabad. Brief Facts of the case are as under mentioned:- 1) That complainant have done the enquiry about Double Bed at the style spa showroom situated at Faridabad, 2) That, where showroom manager told the complainant that there is 40% discount for the month of November on all furniture products, if the MRP of the purchased products would be more than Rs. One lacs.(A brochure is enclosed of this scheme) 3) That the complainant have choose four products including double bed ,so that total amount of MRP of the purchased goods would exceed the ceiling of Rs. One Lac, to get eligible for the 40% discount scheme. 4) That the show room manager has issued two quotations for the above products and showed the discount therein. 5) That after getting the quotation the complainant has given order the above four products as on 25/11/2013 and issued the two cheques of full amount in favour of the style spa co. 6) That the show room manager promised to deliever the above four products as on 28/11/2013,and also assured/written in the order form bearing No. 218651 and 218650 dt 25/11/2013.(enclosed) 7) That the showroom manager cleverly deposit the cheque of first three items and did not deposit the cheque of fourth item(DOUBLE Bed).However complainat has reminded them various times to deposit the cheque of fourth item and also offer them to pay the amount through his debit card so that the delivery of goods can be done in scheduled time. 8) That on 28/11/2013 showrom manager failed to deliever the above four products,after repeatedly insisted by the complainant ,they deliver only three goods as on 30/11/2013. 9) That after doing repeated enquiries about the delivery of the last fourth item, the showroom manager told the complainant that they can not deliver the same because on this item the discount of 40% does not apply and the complainant have to pay the full amount of that item as per MRP. 10) That complainant has done various phones and emails to there customer care and sr officers but they all are very clever persons and they told that not to deliver the fourth item.
Therfore, it is requested to give the compensation of Rs. Five Lacs for mentally harassing and disturbing to the complainant and Rs. One lac for adopting unfair trade practice and misleading facts to promote sale, by the style spa showroom at Faridabad and not delivering the products as given scheduled time. Give instruction to the style spa co. to deliver the last four the item i.e solid wood(sheesham) double bed king size to the complainant immediately
