The above named complainant most respectfully sueth as follows:

1. That I am the complainant and Proprietor of M/s Baidayanath Traders
Plot No 651, Ebaranga, Sundarpada, Bhubaneswar – 751002.

2. That on date 2.5.16 I paid an amount of Rs 1000/- as advance ( out of the full and final amount of Rs 1500/- ) to the OP for printing and installation of two numbers of flex boards for my shop within 7 days from the date of such advance and that the balance amount of Rs 500/- was to be paid on completion of the work. Later the OP came to my residence on date on 19.5.16 and collected Rs 1000/-. The OP has already taken Rs 2000/- but has neglected to return Rs 500/- since 19th of May 2016 as promised by him. Since then the OP is neither answering my phone calls nor replying to my mail.

3. That as on today i.e. 8.6.16 after more than a month from the date of receiving the advance the OP has failed to keep his promise and the OP has not yet installed the two flex boards in front of my shop. Although repeated emails have been sent to him as reminder to install the flex boards the OP has not replied to the mails nor the OP is answering my phone calls so far for which I have been mentally and financially harassed and tortured and sustained a loss of more than Rs 50,000/-. Owing to non-installation of the flex boards for proper advertisement of my shop and business my business has been further hampered by about a further amount of Rs 1,00,000/-

4. That the OP has deliberately and intentionally caused delay in performing services to me. Therefore, under the Consumer Protection Act for service deficiency and losses in business to the innocent consumer the OP is liable to pay a sum of Rs 1,50,000/- to me along with Rs 10,000/- as litigation fees.

PRAYER

It is, therefore, prayed that the Hon’ble Forum may be pleased to admit this complaint and issue notice to the OP for answering the show cause and after just and judicious hearing, kind appropriate orders may be passed in favour of the Complainant by awarding the compensation dues from the OP due to most willful negligence and deliberate harassment to innocent complainant consumer for which the complainant shall as by duty bound forever pray.
