I joined Talwalkars Gym at M 63, M Block Market, Greater Kailash II, Delhi, in April 2014, signing up for a year-long membership and three month personal training, paying a total amount of Rs 61339/-. In July 2014, the Gym was arbitrarily shut down, without any proper information or intimation to its many members or clarification on policy on refund of the money deposited. At the end of July, after mounting pressure from members, including a notice sent by over one hundred of us, we received a letter from the Management stating the Gym is shutting down and those who opt for a complete refund of their fees, will be provided the same, after deduction of necessary taxes. The same was duly communicated to the Management by me, in response to which, by late August, part of the refund due to me (that is Rs 14,879 out of a total of Rs 39,879/-) was paid to me, with the assurance that the remainder of the Rs 25,000/- would be paid within the next sixty working days. In the intervening period,I have sent several email communications to the Talwalkar-Pinnacle Management, along with innumerable cellular messages and telephone calls, none of which has been met with any response. In all of the above, I have repeatedly sought a timeline for the payment and other details, which have not been furnished. On 08 November 2014, I received a letter dated 03 November 2014, enclosing a cheque for Rs 10,000/- only, as against the Rs 25,000/- assured to me within sixty days by the letter dated 26 August 2014. The letter states that the balance will be refunded within sixty days. This contravenes and dishonours the terms set out in the letter dated 26 August 2014 which are binding on Talwalkars-Pinnacle. I wrote to them stating these concerns via letter dated 17 November, demanding that the entire amount of Rs 25,000/- be refunded to me, in one go, in the next fifteen working days, failing which I will be forced to take legal action. There has been no news, response or communication from either Pinnacle Fitness, the Company running the Gym, or Talwalkars Management – both headed by Director Madhukar Talwalkar.

I wish that the entire amount due to me, that is Rs 25,000/-, be refunded to me at the earliest.
