I had bought a Samsung galaxy S (GT I9003) from THE MOBILE STORE/Fancy Bazar/ Guwahati on 28/10/11 and took an extended warranty of 2 years on 03/11/11. My hand set was working fine till August 2013 when it develop problems with the touch screen and software upgradation for which i took my handset to the mobile store and submitted to them on 30/08/13. They assured me that the hand set will be repaired and I will get the handset within 20 days as the parts necessary is not available with them and they have to send it to Kolkata. After 20 days when I called them they told me that the handset has not return from Kolkata and when it will come back I will be informed. But I didn’t get any call so i again called them up on 07/10/13 when they informed me that till now the approval has not come from the company for which i was provided no of one Mr Sailesh Chauhan (09167032296) and was asked to talk with him regarding the matter. I called him up and he asked me to give the IMEI no and the extended warranty no through SMS which I did. But after that he stopped receiving my call and didn’t receive even one call of mine on that day. Then i called up THE MOBILE STORE customer care no and registered my complaint on 08/10/11 against complain no MSCO10027015 and was assured that I will get a call back within 72 hrs which I again didn’t get. So on 11/10/13 I called up THE MOBILE STORE talked with Mr Akshay. After again narrating my problem i was assured that i will get a call from them. On the same day I got a call from Mr Akshay on behalf of THE MOBILE STORE and was told that the insurance company has estimated my liability to INR 3000 only and I will be refunded the amount once I submit the bill for the repair. I told him that i had not done insurance of my phone but i had done extended warranty and the company is suppose to repair the defect and give back my handset for which he said that only INR 3000 has been approved by the insurance company. So I told him that either u repair me the mobile as per the extended warranty or else I will be force to go to the consumer court for which he again was being unhelpful. Hence I decided to approach the consumer court for redressal of my grievance on the following points. 1. Delay in repairing my handset and informing me also. 2. Not carrying out the promised services. 3. Trying to dupe customers by unfair trade practices. 4. Not attending to customer’s genuine grievance on time. 5. Causing unwanted harassment and mental torture to customer. 6. Wasting customer’s time
i want them to repair my handset at their own cost and compensate me for the harassment they have given me
