Tradus.com – Damaged Mobile received while purchasing online

I purchased Xolo Q700 mobile phone online from Tradus.com on 5th July 2013 for Rs. 8861/- and it was delivered on 11th July 2013. On next day when I opened the seal of the Mobile box, I found the screen of the mobile broken so immediately I contacted Vendor via Tradus.com he said that we never opened the seal of the mobile phone and forward the mobile phone as it is to the customer so its better to contact directly to the Xolo Co. Accordingly I contacted Xolo co. They told me to send an email with all details along with the screen shot of the broken place. I did the same but I did nt get any reply from there so again I contacted to Xolo Co. they assured me to wait few days but I did not receive any reply from there nor any call I received. I contacted again and again and at last on 16th July they said to submit the Mobile at collection point in Faridabad so on same day I submitted my mobile phone at collection point. In this regard I received an email from Xolo Co. that it will take 5 working days to get back to you so on 22nd July I again contacted there as I did not receive any update from there; they said that they are forwarding the complaint to the Technical dept. and with in 24 hrs you will receive a reply/call . I again did not receive any reply/call from there so on next day I again contacted there and they again send a request to technical team in this regard. On 23 July I received an email from technical team that there is a damage in mobile phone and its not covered in warranty so I need to make payment of around Rs.3800.00 for repairing. I immediately revert back and ask them why should I make payment even though I received the mobile as broken but till date they have not replied to my email and still they are pressurizing me to make payment unless they will not send back my mobile phone. My concern is why should I pay the money when there is no fault from my end.

I want Xolo Co. should repair the mobile phone free of cost as it’s not fault from my end or replace with a new one. Also, please compensate me against mentally torture, regularly chasing up even then not responding to my concern. They must be punished so that they should not do with others in this way.
