Unitech Horizon – Delay in Possession of Apartment

Sub: Delay of more than sixteen (16) months in physical possession & registry of flat No. 1702, Unitech Horizon, Pi-2 Greater Noida even after payment of all dues within 21 days of getting offer of possession on 23rd March 2013 1. Refer to your letter UL:RED:NRUZ:139098 dated 23rd March 2013 regarding “Execution and Registration of Conveyance deed and Physical possession of Apartment no. 1702 Block No. 19 at Unitech Horizon, Plot no.6, sector-Pi2 (Alistonia Estate), Greater Noida. 2. I, Sanjeev Kumar Joshi is the customer of your company and bought an Apartment no. 1702 Block No. 19 at Unitech Horizon, Plot no.6, sector-Pi2 (Alistonia Estate), Greater Noida. My customer code no. is UZ0832B. 3. I got an offer of possession on dated 23rd March 2013 from you with a requirement to clear all the dues within 21 days and to collect the possession letter. As per your letter under reference, I have deposited Rs. 28143/- vide receipt no. 014061 towards miscellaneous charges, Rs. 67100/- vide receipt no. 014062 towards miscellaneous charges, Rs. 52500/- vide receipt no. 014063 towards contingency /security deposit all on 11th April 2013 through various demand draft payments. I, as a good Samaritan paid all the dues in time & probably of losing money in paying the interest. 4. I got the Possession letter having Reference: UL:RED: 140193 dated 11th April 2013 which was marked to Site Engineer, Unitech Horizon, Plot no.6, sector-Pi2 (Alistonia Estate), Greater Noida with an instruction to ensure physical possession of the flat to allottee within three weeks from date of issue of the possession letter. A copy which was marked to me was given to me. 5. On the same day after reaching the flat site, I met the Mr Pushpendra Solanki, as described on offer of possession. He informed me that the flat will be given within 2-3 months due to shortage of labour. He also informed me that right now registration in Greater Noida is not open hence registry of the said flat may not be done right now. I, again as a good Samaritan and took his words and wait for next three (03) months. 6. In the mean time, I met Mr Rajesh Sinha too in Unitech office on expressway and he also informed me the same as told by Mr Pushpendra Solanki, the site engineer. As both the people were in consonance, I concluded the information in positive manner and waited for next three months. 7. After completion of three months, I again met with Mr Rajesh Sinha & Mr Pushpendra Solanki and I was surprised to note that no work has been started. The flat was in same condition as it was seen on 11th April 2014. I as a customer felt deceived and tried to take information from the abovesaid persons. They again told me the story of shortage of labour & informed me in a very non serious manner that registration in Greater Noida is not open hence registry of the said flat may not be done right now. They asked me to have patience for next three months to get physical possession of the flat. As project

1.This delay is causing continuous financial and mental harassment to me as I am a government servant and took loan from the bank on which continuously more than 10% interest is being levied by the bank. Till date I have paid more than Rs 4400000/- (Rupees fourty four lakh) for which the amount of interest from 15th October 2008 will amount to more than Rs. 25 lakhs and if counted from the date of offer of possession i.e 11th April 2013 it amounts to more than Rs. 5 lakhs (financial loss). 2. This is a big harassment to a government servant/ any customer who is honest and rule abiding. Due to this harassment, I am unable to perform my duties in my department up to the fullest which may reduce my promotional avenues (financial loss). This harassment is going tall on my health too (financial loss) and the same will be indicated in my future course of action.
