I bought a new Yamaha Motorbike, (Model: FZ-16 FI) on Sunday 14/06/2015 at 05:30 pm from the authorized dealer of Yamaha at Usmanpur. I purchased it on my younger brother’s name, “Hemant Joshi”. I paid Rs. 50350/ in cash and surrendered my old vehicle valued at rs. 9500 on the spot. Remaining balance was decided to be finance by their own financer. The manager at showroom, ‘Mr. Kamal’ provided me with the cash receipt and Gate pass for the new vehicle and assured me to collect the remaining documents i.e. Duplicate Registration certificate, Insurance policy, Vehicle Finance papers and Booklet etc next day i.e. on Monday when he will call us. But, We didn’t get any call and on Tuesday when we visited there papers were still not ready and unfortunately this incident took place on Wednesday morning (17/06/2015) between 04:00am to 06:00am that our new Vehicle got stolen from outside of my home. I went to log a FIR regarding that same day and cops told me to collect the RC to get the case registered. I went to the showroom to collect my paper for the vehicle which got stolen in the morning. But, I got the Insurance certificate applicable from the day of Incident i.e. 17/06/2015. It is clearly mentioned on the Insurance certificate that my vehicle has been insured on 17/06/2015 at 12:39pm in the afternoon. Now because of the carelessness of that Showroom manager I can not apply for an Insurance claim because of delayed Insurance poicy of my vehicle. It was his duty to Insure our vehicle from the date of purchase but he did not do that. When I discussed the incident of theft with him he asked me to get Rs. 35,000 cash so that the vehicle can be shown as a Cash purchase in total and he was promising me that some changes can be done on that Insurance certificate as well. He assured me that I will get my claim once I’ll pay him the remaining balance of my vehicle which was earlier on EMI through their Finance service. I found him suspicious and denied to pay the remaining balance in cash and now I am totally helpless.
Now, I want that a legal action must be taken against that authorized dealer who sold me the vehicle without insurance policy on that date. I would request you to please look into the matter and assist me with the correct thing. You people are the right judges to decide what should be done in this case as It would be very difficult for me to pay the remaining EMI’s to their Finance service provider as I have nothing called an Asset with me and I am very upset with their rude behavior. Please assist me with the claim from that agency (Authorised dealer) because of whose mistake I can not claim for my Vehicle as the insurance amount and all paper were signed on the date of purchase. Kindly do the needful.
