A1 Course in French – Refund of fees

My daughter,Ms Mridula Vijairaghavan had paid Rs 11625 towards fees for A1 Course in French set to commence from the third week of July 2013. However, before the course could commence she was diagnosed with a serious ailment, ameloblastoma of lower jaw and was required to undergo a SUPRA MAJOR SURGERY LASTING OVER 8 HOURS, on 25 July 2013. On 15 July 2013, since she could not attend a single session of the course, (in any case the session did not commence as originally scheduled in the second week of July) Alliance Francaise was requested to refund the fees, subject to deduction of reasonable administrative cost, which the Institute orally refused quoting inadmissibility under their rules and expressing willingness to consider holding the fees in trust for the next session, which was not possible to attend for practical reasons for Ms Mridula. Upon further representation to the Director, the same plea was repeated (reply dt. 28.10.2013 enclosed). This appears wholly unjustified for the following reaons : 1.The reasons for claiming refund were reasonable due to health condition (Biopsy report enclosed. If necessary Hospital discharge card may also be produced. She was required to be inhospital from 24 July 2013 to 14 August 2013). 2. Not a single session of the course could be attended by Ms Mridula, hence the Institute had not incurred any expense or effort warranting rejection. 3. The Institute’s decision is arbitrary and unjust and the rules, if any, framed by the Institute appear to be weighing heavily against the interest of the consumer, i.e. the student. Such rules need to be amended to represent a sense of justice and fairplay. Fees must be refunded subject to deduction of token charges, if any. In view of the above reasons, it is prayed that the Institute be directed to refund the fees being held by them illegally and without adequate justification.

The unfair holding of the fees of Rs 11625 has caused substantial economic pressure on the applicant, who is a pensioner and cannot afford such exorbitant losses, especially without reason. Added to the mental and physical strain of the medical condition of my daughter, the financial distress caused by the Institute’s decision has been enornmous and I seek your indulgence in delivering justice to the aggrieved.
