Sir,
I am Supdt of Customs now posted at Kolkata. I have purchased a flat alongwith 4 other at 26 Biren Roy Road East, Kolkata -700008 from M/s BD Construction (Developer & Promoter) in Jan this year. The construction has not been completed in terms of Plan sanctioned by Kolkata Corporation. In that the roof top (terrace) is damaged, the garage shed are of low garde seaping water, the path is dangerous prone and accident may occur. This all problems were told to the Promoter many number of times but no action has since been taken. All the occupants has approached a civil engineer for inspection who has submitted a report alongwith photographs. To make up the damage the occupants of the said apartment now want to file complaint in your esteemed Court for seeking damarage charge from the Promoter. Please advice/guide for the same.
