Apartment Not Allotted -KRISH CITY, BHIWADI – Carnation Developers

I had booked a flat at Krish City, Main Alwar Bypass Road, near Power Grid, Bhiwadi. This project is being developed by Carnation Developers Pvt. Ltd. (CDPL), Gurgaon. In March-2012, through a newspaper, I found an agent of the CDPL Amit Gupta (09582333390) and his associate Krishan Sharma (09829710557 & 09587944446). Krishan Sharma approached me for the booking. I agreed to buy a 2 BHK flat for a price of Rs.22.15 lac and paid the advance of Rs.2.04 lac in the second week of April-2012. Amit Gupta assured me that I would be allotted a flat in 3 months (i.e. by July-2012). The Company has not yet allotted me a flat nor CDPL/Amit Gupta did give any receipts for the payment of Rs.2.04 Lac made by me. I wrote few e-mails to the Company (trailing e-mails) but did not get any reply for any of my e-mails. However, I made many telephonic calls to Amit Gupta but he did not pick any of my calls. Then I made calls to the company and was able to contact Aastha (08800581115), the company’s client relationship executive, on 17-09-2012 (Mon) and she assured me that she would send the allotment letter and payment receipts by 24-09-2012 (Mon), but that too did not happen. I waited till 27-09-2012 (Thursday). Then I started calling both Amit & Aastha and neither of them responded to my call. The last call I made to Amit & Aastha on 30-09-2012 (Sunday). Amit, as usual, did not pick the call and Aastha picked the call only to tell me that she won’t attend official call on Sunday. Ironically, when you wish to buy a property, the selling company makes full arrangements for site visits and meetings on Sundays but when you have a grievance against them, then Sunday becomes the off day.

Respected Sir, I want to know whether I had committed any mistake by booking a flat with CDPL? I fear that my hard-earned money of Rs.2.04 lac has been usurped by the Company and its agent. I had complained to the Chief Minister of Rajasthan in October-2012 through e-mail but I have not yet received any response from them. After informing CDPL through e-mail about my complaint to the CM of Rajasthan, their Customer Relationship Manager Ms. Anju Hooda (9560714447) called me and I had requested her also to refund my hard-earned money but of no avail. In November-2012 end, the company sent me a call letter to pay the call money with interest on delayed period. I replied to them in the second week of December-2012 that when the company didn’t give me any allotment letter how could they demand call money. Also the call money demanded did not match with the price I had agreed to at the time of application. Even today, neither did I receive the allotment letter nor the reply of my letter to CDPL sent in the second week of December-2012. Its more than one year now, to save myself from these hardships & mental harassment by CDPL and its agent, I want to withdraw my application and cancel the flat booking with CDPL due to its dishonest attitude towards its investor.

Cancellation of the application and refund of my investment of Rs.2.04 lac with interest @ 1% pm from the date of payment made by me to the date of payment made by the Company to me. Though, I am not demanding any compensation for this mental agony.
