Bata Shoes Damaged Within 3 Weeks – No Warranty

On 30.8.2014 I bought a shoe from Bata Shoe Store, S.M.Street, Calciut paying Rs. 3699/-. But within three weeks both shoes got fully damaged; about 80 % of the upper portion of both shoes detached from the sole. On 3.11.2014 I approached the shop manager for a replacement. With much reluctance, finally he agreed to replace the article. I bought another shoe paying Rs. 2699/- and one chappal paying Rs. 1699/-. I paid Rs. 500/- towards the balance amount. But, please note that within one week the upper portion of that chappal also separated from its sole. On 17.11.2014 I came to the shop for a replacement. But that time, your manager outrightly dismissed my request and hence this complaint. (In the meanwhile, I would like to inform you that I had to wait for about 45 minutes in the showroom to meet your manager) You may note that the shoe cost Rs. 3699/- and the chappal was of Rs. 1699/-; but both of them within weeks got totally damaged, by which the trust in your product is completely lost. Your internet page says “ Bata understands the shopping confidence afforded by a satisfaction guarantee. That’s why we guarantee our merchandise to be free of manufacturing defects. We will gladly accept any defective item for repair, refund or exchange at any retail location within the country of original purchase “ Later I came to know that my experiences in this regard are not stray incidents, I came to know that many of my friends had the same experience on purchase of your products. Since you did not replace the fully damaged chappal I had to purchase another chappal that of another manufacturer; he purchased a chappal from Lee Cooper paying Rs. 1899/-.

From the above two incidents I lost all my confidence in your products and hence I am not inclined to have a replacement from you. Apart from that I had already purchased another chappal paying Rs. 1890/-. All these expenses and inconveniences were caused to me solely due to your selling of substandard articles coupled with the indifferent attitude of your manager. Therefore you are hereby required to pay me Rs. 4589/- (Rs. 1699/- for the Bata chappal + Rs 1899/- I paid for the new chappal + Fee of the lawyer notice Rs. 1000/-) within fifteen days of receipt of the lawyer notice from my advocate, failingwhich I will be constrained to take legal actions against you and you will be liable for all costs and consequences arising out of it.
