I had booked a flat in Blossom County project in sector 137 Noida expressway in April 2010. The flat size is 1425 sqft. I was promised possession in 18 months but till now the project in not complete. A few months back I get a mail (see below)that the saleable area of the flat is revised to 1350 sqft. I received a call also from Ms Mitali to come to their office and discuss the matter. I replied by mail that I do not accept their proposal of changing the area of the flat since the agreement was for 1425 sqft. If, however, the area has to be revised then I will prefer a larger flat (1575 sqft) rather than a smaller flat. I would like to know how the builder can revise the area as the Tower is already constructed as per the originally sanctioned Plan? Had he told us about this in the initial stages then we could have opted for a bigger flat. I am now asking for a bigger flat (1575 sqft)as the mistake is not on my part. And the difference in payment will be at the original booking price. Since it is not my fault that they are unable to provide me 1425 sqft flat why should I be penalised when it is their mistake? There is another friend of mine who is facing the same problem in the same Tower on the third floor. Logix is not prepared to offer us a bigger flat. I need advice as to how to proceed further on this matter.
