Club Mahendra – Refund of Membership Fee poor service

Complaint for Membership ID:2404600 I had attended a Club Mahindra promotion where in a detailed session by Mr. Mudasser Khan we were explained the membership features. We were also offered additional freebies to sweeten the deal. However at the end of a 4 hour session, we were told that the entire offer was subject to us MAKING THE DOWNPAYMENT THEN AND THERE. It was already around 11pm and we had not had dinner. I requested that though I did intend to take the membership, I needed little time to make up my mind. But we were told that our personal details like name, spouse name, phone no., address etc. had been fed into Mahindra Holiday database and if I did not pay right there, I WILL NOT BE ABLE TO AVAIL THE SPECIAL OFFERS EVER AGAIN. Already exhausted by last 2-3 hours presentation and hunger, I felt blackmailed by such coercive measures and ended up paying around Rs.28,000 downpayment. Next day I spoke to my already member friends who advised that though the product is good it needs advance planning and booking as there are many members. Since I was not sure of being able to avail the benefits under the scheme due to my busy office schedule, I went back to Club Mahindra office THE VERY NEXT DAY and requested a refund. Mr. Mudasser Khan told me that the initial down payment was NON-REFUNDABLE. I was also suggested ways and means that by paying next three installments my special offers will become live and I may avail those and then discontinue the membership. I then received a membership booklet going through which I read that I was entitled to a RESCINDMENT PERIOD OF 15 DAYS UNDER WHICH I COULD AVAIL REFUND OF MY DOWNPAYMENT. I felt utterly cheated at Club Mahindra’s marketing malpractices wherein FIRSTLY I was not informed of this provision despite going back specifically for it and SECONDLY, this booklet reaches the member after expiry of 15 days period under which the option can be exercised.

I want refund of my membership fee alongwith interest from Feb 2012 and any compensation that the court deems fit for waste of time in following up for refund. Court may also direct them to avoid such malpractices and harassment to customers.
