Deduction of Rs.25,000/- in advance booking of a flat Amount- Rs.1,00,000/-.

Dear Sir/Madam,

I had booked a flat in the captioned township on 16.03.2011 at Kovaipudur, Coimbatore and had given an advance of Rs.100000/-(Rupees One lakh only). Subsequently, due to unavoidable circumstances, I have stated my cancellation request on 07.06.2011 thru mail requests, letter requests and personal follow ups and finally a refund cheque for only Rs.75000/- was handed over on 18.09.2011 i.e after 3-4 months from my cancellation request and that too after running pillar to post. I also wish to inform that I had not entered into any formal agreement with M/s Rakindo Kovai Township for the purchase of the flat , but still I am penalized with a deduction of Rs.25000/-( about 25% of advance amount) stating the reason as “Company Policy” for deduction of 25% during cancellation. It is really surprising and with great regret to note that a builder deducts 25% of the advance amount during cancellation. This is not a justified act.

I require the consumer complaint forum to resolve the issue and provide me justice in this case for getting back my 25% amount i.e Rs.25000/- besides compensation for the trauma,mental agony and stress caused for recovery of amount along with interest amount for the delayed repayment of Rs.75000/-
