1. ThatI am subscriber to DTH services of DishTV for more than 10 years. 2. That Last subscription was paid on 02.02.2014 with validity to view upto 14th April2014 3. That from 1st April’14 Colour Plus HD and History HD was withdrawn from my package. 4. That earlier also CNNIBN Channel was also withdrawn subscription validity period. 5. That for these cases , I was informed by my service Provider that the channels are now part of La Carte , for which I need to pay separately. 6. That these channels were deactivated during the validity of the subscription 7. That reply from DISHTv is that it is the company policy to remove channels at any point of time. Beside increase in cost of operation is the reason of removal. 8. This act of removal of channels by my Service provider is in Gross violation of Para 9,9A.9A(b) of “The Direct To Home Broadcasting Services (Standards of Quality of Service and Redressal of Greivances(Amendment) Regulations, 2009 of Telecom Regulatory Authority of India. 9. That even general business principle follows the ethics of providing the committed services for which payment has been made in advance. Any change in package content and cost can be from the renewal of the subscription and definitely not during the validity of subscription. 10. That if the policy of DISHTV hold goods in the eyes of Law then citing this, any payment in advance for the committed service lose its justification. A caterer may withdraw few dishes , Bus service provider will force you to drop in between the destination citing it is their company norms. 11. That the basic question is that can a company have a policy which is against the law of the country (TRAI) or even which defies any logic and principles of Law of Contract ?

1. That Penalty as per the provision of TRAI Regulation be imposed on DISHTV 2. That recovery of such undue and unethical enrichment which DISH TV has earned by removing channels during the validity of subscrition and thereby compelling the subscriber to pay twice for the channels , so removed. 3. That reasonable estimate of such unlawful earning, in total disregard for the TRAI Regulation and Rules , can be made by – Number of Channles so removed during the validity of Subscription over the years X Per Month La Carte Rates of such channels X Number of Months such La Carte Rates were illegally collected by DISHTV . 4. That strict stricture be passed against such action of DISHTV 5. That wide pulicity thorugh print and live media may be given for such bad practices that is being followed by DTH Service Provider
