Ford – complaint about not giving car after full payment

Dear Sir / Madam 1. Please refer booking No GGMG / 868 dated 14 August 2013 and Bank of Baroda cheque bearing machine No 000087 dated 13 August 2013 vide which I had paid an advance of Rs 50,000/- to Harpreet Ford at Delhi. 2. I write to you to formally lodge a complaint about the extreme and unfair treatment, mental agony, stress and anxiety caused to me by the total insensitivity and lackadaisical attitude of Harpreet Ford. I had booked a Ford Eco-Sport Titanium Optional Model Colour Moonlight Silver with Harpreet Ford and at the time of paying the booking amount, was made to understand and assured that the car would be given to me within one or at the most two months. 3. It is regretted that once the advance was taken, all the representatives of Harpreet Ford or Ford India stopped responding and taking my calls. On one occasion, I even sent an SMS to the GM, congratulating him on his promotion and requesting him to let me know what time will be convenient for him so that I could speak to him. However, no response to the SMS was received by me. 4. Towards the middle of October 2013, I was told that my chances of getting a car will be better if I pay the entire cost of the car to Harpreet Ford. Accordingly, I took a loan from my bankers and paid the amount to Harpreet Ford, vide Bank Of Baroda Bankers cheque No 250893 dated 29 October 2013. No receipt of the bankers cheque or amount has been given to me till date and needless to say, my EMI towards the bank loan has already started with the promised car being nowhere in sight. 5. Again, towards the middle of Nov 2013, I was pressurized by Harpreet Ford to either change my colour preference or accept a lower model. I was also again assured that even in case I refuse, the car model which I had booked (Titanium Optional Moonlight Silver) will be made available to me by either by end of November 2013 or at most by mid December 2013 positively. Once again, the above just proved to be empty and hollow promises and inspite of my best efforts, no body from Harpreet Ford took my call. 6. Now, I have again been told to accept the car either before 31st Dec 2013 or be prepared to wait till the end of February 2014, which is totally unjustified and tantamounts to a dubious and restrictive trade practice of forcing a customer to accept a car in the last days of a calendar year. I am an army officer with income only from salary and as is well krown, nobody from the salaried class buys a car at this time of the year primilarily as the model at the time of re-sale will be classified as one year old based on just this 2-3 days period, which does not make any kind of economic sense to the salaried class. 7. The above mentioned behaviour of Harpreet Ford has actually brought lots of disrepute to Ford India. It is just not understood as to how when I was promised and made to believe that cars had started from plants in Ch

1. I would request you to ask Ford India to kindly provide me the following information with regards to my booking status :- (a) How may Ford Eco-sport, Titanium Optional Model cars in Moonlight Silver colour have been made after my booking amount was accepted on 14 August 2013. (b) How many persons who have booked Ford Eco-Sport Titanium Optional Model in Moonlight Silver colour after 14 August 2013 have been given the car. (c) How many people mentioned in ser 8 (b) above who are owners of Food Eco Sport Titanium Optional with Moonlight Silver colour had paid the money in advance to Harpreet Ford? (d) If the company did not have the requisite car, why then did they ask me and accept full payment of the Ford Eco Sport Titanium Optional with colour Moonlight Silver car ? (e) At least the company must provide me with a proper receipt of the amount taken so that I can give the same to my bankers. 2. My car be given to me latest by 15 January 2014 at the same price for which full payment has already been taken by me. 3. Ford India be asked to compensate me with interest on the total payment taken, reimburse me an amount of Rs 85000/ and a fine of Rs 100000/ be imposed on Ford India for dubious and restrictive trade practices of enticing customers by taking full amount so that customer cannot shift to any other car brand. 4. A further fine of Rs 100000/ be imposed on Ford India for the extreme harassment,loss of face before family and colleagues, mental agony and gross deficiency in service caused to me by not giving me a car even after taking full payment.
