In March 2013, I booked an unconstruction flat at Godrej Garden City, Ahmedabad by paying application money. I had explicit told them that I need one fixed parking. I was promised that on mail. I was told that in few weeks the allotment will start. I kept following up with them for months for allotment letter. I have mail communication of it. Allotment letter was finally sent in Aug13. I accordingly had applied for home loan from SBI which was approved in Aug13. Again the follow up started for agreement which went on for months. Finally in October13, they sent the ATS. The ATS did not mentioned anything on parking. I asked them for refund. The mail was sent to Parmeshwar Godrej and Adi Godrej. Finally they replied to me saying that they will not refund anything (as I signed application form). Also mentioned that parking assurance has been given on the mail and that should suffice. In fear of losing INR3.67Lac (application + allotment money), I signed the ATS. ATS was sent to them and received at their lawyer’s office on 31Oct2013. Again follow up started to register the ATS. They would not reply. My home loan pre approval finally expired in Dec13. On 24Dec2013, they sent an invoice asking for next round of payment. I replied to them saying that no more payment will happen till ATS is registered. Now they want to add more pages to ATS and asked me to sign. Its almost been an year and I find the entire corporate unethical and hence do no wish to put more more and add my grievance. I want my refund of INR 3,74,303/- (3,67,053/- – paid to builder so far, INR 3750/-paid to SBI for loan processing and INR 3500/- paid to their lawyer). Please also note that I have to send them atlest 2-3 reminders to get acknowledgement of payments. I feel trapped. Kindly help me get my refund.

I want refund of INR 3,74,303/- I also want them to reimburse me for the loss of interest of the above amount and mental enchantress which I had to go through.
