Gulshan Developers – Disputes – Caution Advisory

I had booked in year 2010 a 2BHK flat in project ‘GULSHAN I HOMZ‘ of ‘Gulshan Developers Private Limited‘ located at Plot No. GH-03A. Sector 16B, Noida Extn., Greater Noida, District Gautam Budh Nagar, U.P. I had booked this 975 square feet flat under flexi plan with total amount of Rs. 19,69,658/-. As per allotment letter issued by builder he had assured to give possession by December’2013.I had paid amount Rs. 2,38,020/- to builder till 6th May,2011 as part of payment plan for this flat. On 23rd September’2011, I received the communication from builder saying that “We take this opportunity to communicate and inform to our esteemed customers that the decision of the Hon’ble Allahabad High Court upheld by the Hon’ble Supreme Court quashing the acquisition of land in village Shahberi, Noida Extension by Greater Noida Authority has affected the future of our project Gulshan I Homz. We, at Gulshan Homz have always been committed to care for and secure the interests of our customer. Motivated with this spirit and to work out solution on the problem arisen from the court order, M/s Gulshan Homz is offering exemplary benefit plan for our valued customers who have chosen to stay with us. In this regard we offer the following option to our esteemed customers; Gulshan Homz is likely to start a project on the alternative land or the present project may continue if the settlement is arrived at. The amount paid by you in the project called Gulshan I Homz will be adjusted against the booking of the flat in the likely project as stated above. Such customers get the benefit of getting the old rate as they were offered in Gulshan I Homz. ” I reached their office after getting this letter to take my money back since project was at disputed land and scrapped by court. The Gulshan Developer executive told me that they they will provide flat at alternate alternate project at plot no GH 02 A, Sector 16 in Noida Extension, Greater Noida very near to our existing project. They had sent following communication via mail reply to me on 22nd October when I asked them the status of project via mail: STAND OF GULSHAN HOMZ FOR GULSHAN I HOMZ IN NOIDA EXTENSION. Dear Customers We would like to take this opportunity to clear the air relating to the recent decision of the Hon’ble Supreme Court to denotify the Shahberi Village in Noida Extension. Our project Gulshan I Homz has been affected under Hon’ble Supreme Court decision and we have immediately stopped the construction work at site. We at Gulshan Homz are awaiting the copy of the decision order of Hon’ble Supreme Court which should be available with us shortly. We are also working out on all possible options to retain the same allotted land where Gulshan I Homz stands today. As we work and review the decision we would like to assure all our customers that your investments are safe with us. Meanwhile we would like to share with you that we are also in the process to offer you alternate

I had booked this 975 square feet flat in approximately Rs 1968000 and now the rates in noida have almost doubled. Because of this builder is refusing to give flats to old buyers and insisting to take refund. I am paying rent of almost 14000 perm month since Developers had first assured to give me flat in December’13.. I am feeling total cheated in this case.
