Happyness Tower – Builder not paid fees Authority delay Possession

This is to bring to your notice that I(Sunita Chaturvedi ; Pulkit Chaturvedi) have booked a flat in Happyness tower Block B, Flat no. 301, Sikka Karmic Greens on 17th October, 2010. As per the current status of the construction, it seems that there are delays in the project. As per the para 26 of the agreement, the allottee is entitled to get Rs 5 per sq ft per month after 36 months from the date of excavation plus extra 6 months . As per the agreement, GS promoters is entitled to pay the consumer delay charges after 42 months from the date of excavation. We booked the apartment on 17/06/2010; considering the time written in the agreement the penalty clause starts at 17/12/2013. Please find below the calculations till date for the penalty clause Date of Booking 17/06/2010 After 36 months 17/06/2013 Extension for 6 months 17/12/2013 Date from which penalty clause will be effective 21/12/2013 Till date 9 months Penalty amount 9*5*1210 Total Amount till date 54450

The builder should now pay 24%PA interest to the amount pending as they take from consumers. There was a time when the bank was not giving the sanctioned amount because the builder did not pay the fees to the noida Authority, still the builder charged us the late payment fees on the demand with 24%PA.
