How eBay India Sold me defective Product ?

Sir, Iam a customer of ebay India. customer id: thomastvla ebay claim id: 674772 I purchased a lenovo smartphone s850 from ebay for Rs 13500 on 20th sept 2014 and revived it on 26th Sept 2014. its a dual sim phone and its one sim is not working . I informed this issue with the seller of ebay on 28th sept 2014. He asked me to show it to service center. As per his advice i shown it to a service center ( 90 km away from my place, Thiruvalla) as lenovo had only 8 warranty service centers in kerala. Service center , told that my phone has some issue they will send it to company and wil inform me once it get ready and the time is 3 to 4 weeks they need. i was not willing to give my phone for service. As i don’t want to take a defected product. I informed to ebay my grievance. But the customer care of ebay told me that they are not responsible for defect of the product having warranty card. They asked me to depend on Lenovo service center. And my complain is closed at their site. Sir, I do understand that ebay is virtual shop. Where it is practically not possible to handle all the warranty issue of a product and the consumer had to rely on service centers while they purchase online and I also agree that electronic product can get some defect on the course of time, that the reason why company give warranty to their product. But my complain against ebay is why should i accept a defected product itself. why should i travel to service centers( 90 km )from the day one of my purchase? why should I spend another couple of thousand rupees to get my phone back. How ebay can sell a defected product to a consumer and say , this product has one year warranty and you please visit service center of that product. I believe the policy of ebay India (www.ebay.in) that a defected product with warranty card is not a liability to ebay is against the protection of indian consumer. If a branded new product is defected , the ebay should replace or refund the money to the consumer.

I want ebay India to replace or refund for the defected product which they gave to me.
