HTC – Denial of ‘Consumer Right to be heard’

I had purchased HTC one V model (IMEI: 353115056254310) on 08-09-12. And since last 2 months I am facing some problems related to hardware as well as software. Microphone of the mobile is not working properly and phone gets hanged very often as a result; I am unable to use even the basic function of my mobile phone i.e. ‘calling’. Despite stating the problem clearly and categorically (on 13-07-2013 and repeat complaint on 12-08-2013), HTC customer service centre is not taking any concrete action. Details of the complaints are mentioned below. I had visited the service center thrice for the same reason. They are just buying the time so that my warranty period gets over. My warranty is expiring on 8-9-13. Every time they keep on telling some unacceptable reasons. In last 2 months I could use my phone for more than 16 days. When I called service center, the guy spoke very arrogantly. Service center people are very reluctant to act. My basic right to be heard is being denied. Complaint Details: 1.Ticket No: 13INA280002440 Date: 13-7-13 Problem: Microphone not working and frequent hangs. Action taken: None (Not even formatting of cell. Returned as it is) Total No of days taken: 8 2.Ticket No: Q9S13D81200002 Date: 12-8-13 Problem: Same Action Taken: Still working Total No of days taken: 8 (still not returned) HTC Service Center Address: TVS Electronics Ltd, Mumbai

want my handset to be replaced immediately. And a letter from HTC stating clearly the root cause of the problem.
