Hyundai – Dealer Harassment false information

Date 18th June 2015 To The Chairman, Distt Consumer Forum, NOIDA Subject: Complaint of harassment from local Hyundai dealership’s Sales Personnel (Ref. Ann. 1) Hon’ble Sir, I, the undersigned, am a 67yrs old person on medicinal support for issues relating to heart palpitations and breathing difficulties and it is not advisable for me to undergo psychological pressures. But, of late, I am being subjected to exactly such pressures only which also give me nightmares. The people behind this harassment are the sales personnel from Nimbus Motors, Sector 5, and Noida against whom this complaint is being brought to your kind notice for justice. The details are the following:- I purchased an i-10 Model Hyundai brand car from Nimbus on 19th March,2015 (Ref. Ann.2) after having finalized it on 11th March,2015 in consultation with a family friend – Mr. B.P.Bharti and after discussions at Mr. Bharti’s office in Sector 80,Noida, with Mr. Pradeep and Mr. Fitrat, of Sales Deptt of Nimbus (Ref Ann.1) The transaction included exchange of an old Santro Model Hyundai car(Ref. Ann. 3), owned by my wife Uma Rastogi, for which I was asked to provide not only the Registration(Ref. Ann.4) and Current Insurance Certificate (Ref. Ann 5) but, strangely enough, the previous year’s Insurance Certificate also. This was definitely a strange requirement because no one ever asks for an older document if the current one is available. They said it was Hyundai’s policy and I conveyed to them that I had not kept old Ins. papers but will try to locate it or procure from my insurance agent. I was told by Mr. Fitrat of Nimbus that since my currently prevailing insurance had not completed 6 months till the time of exchange of old car, previous year’s Insurance was needed only to establish continuation of same ownership. The most authentic document to establish this fact could have been the Regn. Cert. but it was not showing the date of Transfer of car from its original ownership (Ref Ann 6) in the name of my daughter Bela Rastogi, (after her marriage), to my wife Uma Rastogi. As a guarantee, Mr. Fitrat asked me to deposit a cheque of Rs. 15,000/- , without any receipt at the time of delivery of new car with the promise to return after I get the documents to confirm continued ownership of the old car for at least 6 months. As I was confident that my Ins. Agent would help me to get a copy of my previous year’s Ins. Cover note, I gave the cheque to him. Despite my best efforts, I could not locate the old Insurance papers at my end. The Ins. Agent also failed to get them for me and I took up the issue with Mr. Fitrat on 28th March, 2015 but he could not suggest any alternatives upon which, I asked him to let me meet a senior person. I was met by Mr. Arvind Dubey (Ref Ann1) who suggested, as an alternative to get the Registration Authorities’ statement showing the date of transfer of car in my wife’ name to prove that it wa

Through this letter, I want to avail your kind intervention to settle this issue and specifically decide the following:- Whether or not RTO’s certification that my wife Uma Rastogi was the registered owner of Santro car from 12th Feb., 2008 until its sale/exchange with Nimbus on 19th March, 2015 stands true and if the answer is yes, it must be accepted by Hyundai or any other agency or individual without any reservation Whether or not Nimbus should stop bothering me on this issue by their phone calls Whether or not Nimbus / Hyundai should close this chapter and without expecting any monetary compensation from me in any form. Whether or not I am eligible for a monetary compensation for the mental harassment I am undergoing.
