iBerry Auxus – Received Faulty phone poor response

The phone model iBerry Auxus Nuclea N2 was purchased through Order No. 12792 dated 01-03-2014. The handset received was faulty on receiving and I started registering complaints from very next week of receiving the product. The complaints were regarding poor audio quality, battery and screen defects. The battery life was very poor from the beginning and every time I called their customer support they asked to do some setting changes or download some software but the issue was not resolved. After reporting the issues several times now when I checked the battery I found that the battery is swollen and which has caused a minor crack to the phone screen. I am asking them to replace the phone battery and the screen but they are now telling that battery is out of warranty and screen issue is physical damage which is not covered under warranty. I reported the battery issue within 6 months of purchase hence it should be covered under warranty and also since their faulty battery has caused the damage to screen the phone screen should also be replaced. The damage is not due to any manhandling of device as I have taken complete care since the beginning, have never dropped it and always prevented from any kind of shock or impact. The company has provided a faulty product and should replace the faulty handset or component. Complaint numbers 493619, 863320 and 438946 were registered with company regarding same starting 7th March 2014.

I need the faulty battery and phone screen replaced at the earliest else the company should reimburse the cost of Rs. 19999/- spent to purchase this phone.
