The Complainant is a peace loving law abiding citizen and a national of India. 1. That, the Complainant states that on February 13th, 2012 he had purchased an IFB Elena VX washing machine from the authorized dealer of the Opposite Party 1 in Jalgaon by making the payment for Rs.19,000/- .[Attached herewith is the copy of the receipt of the payment as Exhibit A.] 2. That, the Complainant states that within a week of the purchase of the washing machine it started giving problems which included the inefficiency of the product to wash the clothes properly. The Complainant further states that he immediately contacted on [enter date] to the executives of the Opponents in order to get the problem resolved. After making the Complaint the product got repaired but the same problem persisted in it after using it again.[ Attached herewith is the copy of the Jobsheet as EXHIBIT B]. 3. That, the Complainant states that he tried to follow up with the Opponent a number of times by calling their executives but he received no response from them and was utterly disappointed due to same. The Complainant further states that each time he contacted the executives of the Opponents he was given false promises and assurances that his product would be repaired soon but out of his surprised none of that sought had happened till date. 4. That, the Complainant states that he had he had a three year warranty of his product therefore a liability arises on the Opponents to fix the problems in the product at the earliest. 5. That, the Complainant is really frustrated and irritated by the pathetic, unprofessional and negligent services offered by the Opponent. 6. That, the Complainant even sent a letter dated November 11th, 2013 to the Opponent, stating in detail his grievance in the hope of getting a response, but was sadly disappointed. [Attached is a copy of the letter and the courier receipt as Exhibit C and Exhibit D respectively.] 7. That this Hon’ble Forum has got pecuniary jurisdiction to entertain this Complaint as the compensation claimed does not exceed Rs. 20,00,000/- 8. That this Hon’ble Forum has got the territorial jurisdiction to adjudicate as the cause of action arose in Jalgaon. Moreover, the Opposite Party No. 2 is a dealer of the Opposite Party No.1 has its office situated in Jalgaon. Hence the matter falls within the territorial jurisdiction of this Hon’ble Forum 9. That, the cause of action is continuing till date as the Opposite Parties has not taken any action on Complainant’s grievance. Therefore, the complaint is within the limitation period. 10. That the Complainant has not filed any such or similar complaint against the Opposite Parties herein, with respect to the same cause of action, in any other court of law. No such or similar complaint is pending adjudication before any competent court of law. The Complainant therefore prays:
