Micromax – Misleading service issued damaged mobile

Dear Sir/Mam, I had purchased my Mobile Micromax Canvas Elanza 2 A121 (Black) on dated 22/05/2014. After use of 4-5 days it was found that the mobile having problem as it started overheating, restart problem with very low battery back. I went to the my nearest Micromax service center ( M/S Solution care,Kotwali chowk, Tatarpur Road, Bhagalpur ,Pin- 812001, Contact no.- 0641-3203474/9334820136/9471292063,TIN no.- 10526423073) immediately for the solution but the representative of service centre told me that it is summer season that why you are feeling mobile over heated and for mobile restart problem it is due to the network problem. So he assure me that you need not to worry you use the mobile if any problem continue we are here to help you. But the problem was continue and finally when I got tired than on finally dated 27/02/2015 I have deposited the mobile at aforementioned service centre as my mobile is still in 1 year warranty with job sheet no.- E040169021515289534, after so many follow up he told me that we have sent you mobile to delhi (head office) for repair and you have to wait for 20 days. After spending 20 days when i visited the service center on 17/03/2015 for collecting my mobile i found that the mobile is in same condition, when representative himself switch on the mobile it get switch off automatically. Then again he kept my mobile at service centre and released me a new job sheet no. -E040169031515584174 on dated 17/03/2015. Later on 20/03/2015 i called micromax customer care department over contact no.- 18605008286 , explained him the issue and request him for help than he told me that we will sort out your issue on priority and gave me a complaint no.- 2003156651 for any future communication and assured me that within 10-12 days you will get your mobile back after repair. But after spending almost 45 days and continuous follow up with the micromax team, i am helpless and micromax service center including its customer care team are misleading me and not ready to return my mobile which is still in his custody. But in meanwhile on 22/04/2015 i got a call from mobile no.-09934315113 who refused to disclose him name as well as his designation advised me to visit the service center on 25/04/2015 and collect your new mobile as your old mobile could not be repaired but when on 25/04/2015 I visited the service center the representative is giving me a old and damaged another mobile Micromax canvas color A120, when i asked the representative of service centro where is my new mobile or my old mobile he refused to provide the same and told me to only we will return you the Micromax canvas color A120(which was in damaged condition) instead of my Micromax Canvas Elanza 2 A121 (Black). But finally I refused to collect the damaged mobile Micromax canvas color A120 and asked service center to return my old mobile Micromax Canvas Elanza 2 A121 (Black), i will manage my own but now he refusing to providing the same also. A

I want new mobile instaed of my old Micromax Canvas Elanza 2 A121 (Black) which was deposited at service cente for repair and now he is reusing to return it. or otherwise refund my cost of mobile i. Rs. 9350/-
