Case HIstory:

I was touring India. As per advice I was carrying the cash less card (expired one) (copy Attached) as I did not get a new card or a new policy copy issued.

On 11th May,2012 morning while walking on the road suddenly my left side started paining and become semi unscious. I was taken to the emergency unit of Pondicherry Institute of Medical Science by a summaritan auto driver.

On checking at Emergency I was referred to Medical wing where it was decided to admit me. I produced the old cashless card and could not talk or sign any paper. Treatment was started and it took hours to neutralize the pain when I signed all relevant papers.

The cashless card was faxed to some Madras office who promptly asked for New Policy No: I called my agent at Kolkata who promptly supplied the number.

To my utter astonishment the next a phone call came asking fax copy of Premium Receipt as well as Policy copy. As I was never told I did not carry such documents. I asked them to refer the policy no which was promptly denied. However assurance was given that it will be favorably honored as my Policy looks like a valid one. Since office was closed for 2 days for Saturday and Sunday assurance was given that Monday case will be set right. On Monday I was told that unless those are faxed files could not be processed. Cashless cards has no value to them. When asked to refer to internet answer was given that they do not trust internet information. So most reluctantly I had to borrow money from a fellow patient came down to Pondicherry took out my ATM card and refunded the loan.

NOw my question to you:

1. What is the purpose of the cashless card where membership no is mentioned and with the nhelp renewal policy could have been traced? Shall I throw this to dustbin as your own office does not honor it?

2. Who will bear my harassment epenses? I had to book a cab take the person to my home to get the ATM card draw money pay him and then drop back to the hospital. It is quite far from where I stay.

3.Do I have a right to move to the court claiming damages for failure in giving the service promised.
