Nissan Motor Micra-XV, petrol car – negligent acts is deficiency in service

I purchased the vehicle Micra-XV, petrol having Chassis No. MDHFBUK13B2007812; Engine No. 663572A of Pacific Blue colour, on 24th October, 2011 from Chandrani Enterprises (p) Ltd. under Chandrani Nissan having its show room at PS Pace Building , 1/ 1A, Mahendra Roy Lane, Kolkata-700046 through Shyam Motors of 140B,Sarat Bose Road, Kolkata- 700029. After purchase of the aforesaid vehicle, the vehicle started taking operational trouble on and off & had to visit the service center Chandrani Nissan on a number of occasions. The vehicle was sent to the service center M/s Chandrani Nissan on 08.07.2013 as it had some problem but after checking by the said service center at P-47, Taratalla Road,Kolkata- 700 086, tmy authorized representative was informed that the defect cannot be rectified as the particular part which needed to be replaced was not available. Consequently I had to send an e-mail to the CEO of Nissan Motor on 11th July of 2013. After sending the e-mail to the aforesaid CEO ,I again sent the vehicle to the said Chandrani Nissan, Kolkata but sorry to state that the said Chandrani Nissan, Kolkata refused to correct/ repair the defect on the same plea that the parts required for replacement is not available & I was also told that my vehicle will be repaired/ serviced only on receipt of required part from the head office of Nissan motor although the aforesaid e-mail had been acknowledged by customer case department of Nissan Motor India (P) Ltd. wherein certain information had been sought & I supplied the same. The vehicle was not attended by any technical person of Nissan Motors or, service provider after 8th July, 2013 & I being an Advocate had to suffer immensely for the defective starting problem of the vehicle. On 3rd September, 2013 the vehicle broke down completely consequently it had been sent once again to Chandrani Nissan which has been accepted under Job Card No. 5378 & I was assured the delivery of vehicle on 12.09.2013 at 4.30p.m. after rectification of defect but sorry to state that the said vehicle had not yet been delivered. I made an enquiry about non-delivery of the vehicle & had been informed that the defective parts required for replacement has not yet been sent by head office of Nissan Motors. The aforesaid negligent acts is deficiency in service on the part of Company & because of such deficiencies in service on the part of Company I had been incurring additional expenses of Rs. 120/- per hour till 10th October,2013 & had to purchase a new vehicle which costed it Rs. 8.8 Lakhs. I, am a senior citizen & being harassed by the Company running from pillar to post for help & I hope I am before appropriate forum for redressal of my grievances. In this regard if anything more is required the undersigned will gladly provide you. This the big sorts like the owner , dealer of Nissan Motors should be booked for their negligencies & supply of defective instruments to the consumers like me who are having an ordinary common prudence. A

Under the circumstances I want to take back the vehicle after paying cost of vehicle Rs. 6,01,476/- & Rs. 47,520/- the cost of hiring vehicle & also Rs. 2,00,000/- as compensation for causing harassment & mental trauma to me.
