Samsung galaxy – Product Defective

I have purchased a brand new samsung galaxy note 3 on 10th May, 2015. The moment we opened the new box and inserted the battery, with a span of 15-20 mins the phone started heating up, we were at the store only, we informed the store manager Mr. Satish Sharma regarding this, he asked us to upgrade it’s software to from kitkat to lollypop. We agreed and got it’s software upgraded to lollypop from the same store. After that also it didn’t stop heating, we asked the manager for help, he told us to keep the phone for a day or 2 and if still problem persists than he will provide us a DOA for the exchange of the product. As per his instructions we waited for 2 days more and still it’s heating up. Then we again visited the mall, where he asked us to visit servicce centre, we visited there and got the product diagnosed twice by the engineer, where they found that mobile is getting heated up to 50.4 Degrees which is above the smsung’s heating temperature standard (48 degrees). There they asked us to submit the product for repairing. we did not agreed to submit the brand new phone. How can we submit our 5 days old phone for repairing, the product was defective on arrival and that is a defective product, why should we bear a defective product. We paid for a new and perfectly working handset, not for a defective product. it’s an expensive product, we have purchased this product after lots of savings. Did we save money just to buy a defective product, not at all. We are going through such a mental harassment and trauma just to get thsi product replaced, but the samsung service center people are not at all cooperating and are asking us to submit the product for repairing. It’s been 4 days from then, we’re facing big trouble to get the perfect product of our hard earned money. Enclosed is the diagnosis of it’s tempreature going to 50 degrees, done by the samsung service engineer at samsung service centre. Please Help !!
