Samsung – Split AC- Deficiency in Cooling

had purchased a Split Air conditioner , Samsung model AS183 BSD 1.5 AC 3 STAR, from the Canteen Stores Department (CSD), Pangode, Trivandrum, Kerala, on 22.10.2011 via Bill no: 34318. The bill was in the name of Ex-service Man K S Sidharthan, the late father of Jessy Sidhan K, the Complainant’s wife. After about one and half years of operation, it gradually stopped cooling the room. The Complainant promptly reported the matter to the Opposite Party and the outdoor unit (with unit serial number B125PZABA00084V) was taken by M/s TopCoolers, the Samsung Service Centre in Trivandrum, Kerala State, on 24.09.2013. The Complainant contacted M/s TopCoolers, Trivandrum, their Area Service Head, Manager Customer Experience, and Technical team members, and also tried to contact Senior executives at CEO level of Samsung Electronics India, a number of times (the Complainant had sent 12 Reminder emails to Mr. BD Park and Mr. JS Ham, the top executives of M/S Samsung Electronics India Ltd.) and the issue still remains unresolved. The details of the correspondence made by the Complainant with the Opposite Party are given in Annexure.

i) direct the opposite party to apologize for all the inconvenience caused to the Complainant; ii) direct the opposite party to make up for the mistake by refunding the promised amount Rs. 18923/- (Eighteen Thousand Nine Hundred and twenty Three only) to the complainant; iii) pay a sum of Rs. 50,000/- (Fifty Thousand Only) towards the physical strain and mental agony suffered by the Complainant and his family members; and iv) direct the opposite party to pay a sum of Rs. 1,000/- (One Thousand only) towards cost of this petition
