My Name, G.M.Tekchandani s/o Late Shri Motiram Tekchandani, Age -63 years, Occupation- Retired chief engineer, Contact- 9827269xxx. I am the complainant in the present case. The opposite party has five members four of them are builders of Nova Classic Colony named as SARaA DEVELOPERS and the fifth is Shri Navin Madan who is a colonizer. 4. A brochure (enclosed) was published by Saraa Developers i.e, the opposite party regarding development of colony named as Nova Classic Colony with plots measuring 1000 sq ft (20×50) and building duplexes measuring 1350 sq ft at village borkhedi of tahsil Mhow. Names of partners of said colony were also indicated therein and copy of relevant papers of diversion issued by Hon’ble SDM Mhow along with copy of license issued from JT Director Gram Nivesh Indore etc. were given to interested in the month of Jan’2011.The work order issued by Madaan Classic Developers Pvt ltd to Saraa Developers was also provided by them. 5 Booking amount was Rs 51,000/= which was paid .The cost of duplex(including cost of plot) was agreed to be 15.51 lacs which was to be paid in periodic installments up to 90% and balance 10% on possession of duplex .The possession date was agreed as 15th December 2011. 6 The registry of plot between the owner of plot and the complainant was executed in the month of June 2011. 7. The agreement for building a duplex was executed between opposite party i.e, Saraa Developers and the complainant .As per the terms &conditions of the agreement payment of the cost of duplex was to be paid in periodic installments up to 90% and balance 10% was to be made upon completion of work and handing over of said building. This date was 15/12/2011 as per agreement. Although, 90 % of amount was paid by complainant by December’11 in installments but neither the work was completed nor handing over was done till this date by the opposite party. Even the essential services like electricity, water, & sewerage arrangements were not complete till Sept’2014 i.e, after the lapse of 33 months of agreed date of completion. On persuasion, opposite party in their letter had assured to complete the work within 45 days from 31/10/12 but afterwards on 03/04/2013 they assured to complete the work by 15/4/2013 .Thus it may kindly be seen that opposite party has betrayed not only the T&C of agreement regarding scheduled date of completion but also failed to comply with the dates conveyed by them self twice in the letters indicated above. From their last communication more than one & a half year’s period has elapsed, and since then there is no communication from opposite party. 8 It is also to mention that opposite party has not worked as per the brochure issued in this regard .which includes attractive landscape, garden with children play area, club house etc. in the colony but these facilities are not being developed. Even the essential amenities like water supply is yet pending. Electricity was also provided very late
