I came in touch with the builder Srishti Infrabuild Pvt. Ltd. through one of my colleague who was also planning to buy 3BHK independent bungalow in same project. The further process started with the sales executive named Mr.Bheekam Sao visited us at IGNTU campus with booking form and other documents. At the very first meeting we asked the executive to provide us with the necessary approved documents of the company to go ahead with the project. He assured us that what ever price we are paying is a pre launching price and the documents approval is in process and shall be completed very soon and as soon as the documents are ready the price will rise considerably. The executive lured us in investing the project by misleading us and providing fallacious information. We filled up the booking form on 11/09/2014 on condition that the company will provide us with the approved documents latest by October end. The executive told us as the policy of the company we will have to pay 15% of the total cost of the property as booking amount which comes around to Rs.5,17,350 which is 15% of the cost of property i.e. Rs.34,49,000. I paidthe executive Rs. 300,000 through cheque of CBI dated 04/09/2014 bearing the number 000183 and also provided him with a post dated cheque of Rs.2,17,000 of CBI bearing the number 000184. After submitting the booking from and cheque to the executive,
I contacted the CMD Mr. Rajesh Dewangan and MD of the company Mrs. Sunaina Dewangan regarding the status of the approval of the documents of the project through respective authorities which they informed will be completed very soon without mentioning any specific date. [133439]

We were not satisfied with response and planned to cancel the booking in the month of November and asked to refund the entire amount of Rs.300,000 paid as token money. We were also informed earlier that what ever amount we are paying as token amount is not against any plot or house but against the project which is 100% refundable immediately if we plan to cancel the booking. We cancelled the booking and asked the company to refund the entire amount immediately but the company refused to do so. We also contacted various important person in the company such CMD-Mr.Rajesh Dewangan, MD-Mrs.Sunaina Dewangan, Manager (Operations) Ms. Aditi Chatterjee but in vain. We try to contact them many times for the refund of the amount and made several calls, sent messages and emails but they hardly responded to these calls and messages. Ms. Aditi Chatterjee sent us mail after repeatedly calling her and after various messages that the amount can only be refunded after 45 days because of the company. We also informed the Manager (Operations) Ms Aditi Chatterjee that it was mentioned no where in the document provided.

I want my entire amount back with interest and also require compensation for the harassment and mental agony me and my family has gone through during this whole process. I would also like that legal action be taken against the builder so that they don’t ever dare to take other customers for a ride.
