Vodafone – Receiving promotional sms

My mobile number is registered in DND registry with preference 0 (fully block category) on 06th November 2014. I have placed an order at YEPME online on 15th November 2014. I started receiving promotional sms from YEPME (message header DM-IYEPME) from 24th February 2015. This is going on till today. Since it is the responsibility of the service provider (Vodafone) to save their customers who are registered in DND (fully blocked category) from promotional sms, I have registered complaint with Vodafone on 25th March 2015 with complaint id 1694280706. There was a follow up call from Vodafone to get further details of the complaint after two days. I have been assured of a speedy solution. I got an sms saying that my complaint will be processed by 02/April/2015. On 30/March/2015 (04:34 pm), I received an sms saying that “Your complaint dated 25/March/2015 has been addressed. If not satisfied, appeal at 198”. After few minutes, I got another sms from YEPME. I contacted 198. To my surprise, I was informed that my complaint with id 1694280706 was not complete. Then I asked Vodafone representative, if that is the case, how I got an sms saying that my complaint has been addressed? He replied that it is a system generated sms. I got another sms within an hour saying that “In response to your complaint, we are unable to reach you”. I presume, this was not “system generated” and Vodafone has purposefully done this to make their records straight. On 7th April, 2015, I sent a mail to “corporatecare.wb@vodafone.com”, to get the current status of my complaint. Ms Rumani Katiyar in the reply mail asked me from Vodafone end “to elaborate your concern for further process from our end”. I replied saying that all the details were collected by Vodafone representative on March itself. With every sms, YEPME says that if you want to opt out of our sms, please send an sms to 56161 with sms content as YSTOP. I have experimented this on 12th March2015 before approaching Vodafone. I got reply on the same day at 08:23 pm “You are opted out of the SMS promotions! It may take up to 48 hours for us to update on our servers!”. From my March 2015 detailed bill, I saw that Vodafone charged me for the message in special category with Rs.3/-. Then Vodafone asked me to visit the Vodafone store which is not there in our vicinity. I asked them to write in reply mail why should I visit the store? Then they replied me to contact Jyotesh.Mehta@vodafone.com or vodafone store. I stopped corresponding with them and waited for some more days whether there will be any change. But the menace is still going on.

The mareting sms should stop completely. For the harassment and the time I wasted to address the problem (voice conversation and lots of mails to Vodafone), I request Vodafone and YEPME together compensate me with Rs50,000/-
