Refrigerator purchased on 23.Sep.2009 under warranty for 5 years from Rhythm House vide invoice # 4741. Cooling issue in March 2013 reported to Whirlpool. Engineer visited on 6.Mar.2013 and told that gas had leaked. Solution suggested was to change compressor. I agreed. Since at that point of time I could not trace the original invoice, the engineer suggested a price of INR 4800 for the compressor (against MRP of INR 3650) + INR 2000 for services provided. He adviced that I should find the invoice later and then ask for refund from Whirlpool. I agreed. When I contested the excess amount charged by them for the compressor, they refunded INR 1200 to me in cash. They requested me not to escalate this issue within Whirlpool. Later, after the invoice was traced by me, I contacted Whirlpool. They asked me for serial number of the refrigerator. I provided. They asked me for a copy of the invoice. I provided. I was then told that someone will visit my home on the 29.Jun.2013 and then provide feedback. No one turned-up until 8.Jun.2013 when I sent another reminder. The two gentlemen who came, took a look at the refrigerator and matched serial number that I had provided with the invoice and on the refrigerator. They confirmed that refund will be made. When nothing happened for approximately the next 10 days, I sent another reminder to Whirlpool. The only response I received was that since the complaint was closed in Whirlpool’s systems as out of warranty, they will not make any refund!! In my response, I reminded them of the fact that others from their teams had confirmed that refund was possible. Now, they have no concrete answer and are dilly-dallying the whole affair!
1. Refund of money paid to Whirlpool 2. Interest on this money 3. Money in lieu of attempt to cheating (by initially charging more than MRP and later denying refund despite confirmation by its employees / representatives) 4. Money in lieu of mental harrasment (honourable court to please advice appropriate amount) 5. Cost of litigation and all expenses thereof…whether direct or consequential 6. Penalty so that Whirlpool does not dare to repeat such a thing again (I request that this goes to the government fund) 7. Full-page declaration in leading newspapers across India by Whirlpool that similar incident (they will have to state all facts) will not be repeated for any customer 8. Apology letter 9. Money equivalent to time spent (approximately one man-day in total) on this issue
