AJNARA DAFFODIL – Possession delayed beyond date

I booked a flat E-401 at AJNARA DAFFODIL, GH-007/B, SECTOR-137, NOIDA in Feb 2010. As per the Allotment Letter dated 17th July 2010 – para on “Possession & Penalty” wherein it has been indicated that the possession of the aforesaid Apartment / Unit shall be done on or before July 2012 and the Company shall be entitled to a grace period of six months from the date mentioned. In the event, the possession is delayed beyond the date on which the extended grace period of six months expires, the Company shall pay a Penalty Charge of Rs. 5/- per sq ft. Per month for Super Area. As per the aforesaid clause, since the possession has not been handed over till date, I am entitled to a penalty charge from Dec. 2012 till Nov. 2014 which works out to Rs. 2,07,000/- (Rs. 5/- x 1725 sqft x 24 months). On the contrary, the builder has been demanding unfair and unjustified interest charges and have informed that the possession shall be given only after these charges are paid off.

a) I want the delay penalty of Rs. 2.07 lakhs to be paid immediately. b) Reversal of Interest Charges leveid by the Builder c) Rs. 10 lakhs additional penalty for mental harassment and damage done on account of extra rent paid during the delay tenor and Income Tax benefit which I could have claimed.
